Fwd: [fcf_discussion] Online Copyright: EU Court of Justice Rules Out Private and Automatic Censorship
by Dante-Gabryell Monson 16 Feb '12

16 Feb '12

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Thu, Feb 16, 2012 at 11:18 AM Subject: [fcf_discussion] Online Copyright: EU Court of Justice Rules Out Private and Automatic Censorship To: fcforum_discussion(a)list.fcforum.net Themes: COPYRIGHT, INTERNET, CENSORSHIP, ACTA, EU COURT OF JUSTICE, SOCIAL NETWORKS, FREEDOM OF EXPRESSION La Quadrature du Net - For immediate release Permanent link: https://www.laquadrature.net/en/online-copyright-eu-court-of-justice-rules-… Online Copyright: EU Court of Justice Rules Out Private and Automatic Censorship *** Paris, February 16th, 2012 – The European Court of Justice rendered another decision in defence of freedoms online. In the SABAM vs. Netlog case, it declares that forcing a hosting service to monitor and filter online content violates EU law. This is a crucial and timely ruling, just when initiatives such as ACTA and the revision of the IPRED directive aim to generalise private and automatic online censorship to enforce an outdated copyright regime. *** In this important ruling, the EU Court of Justice follows a similar reasoning to that of the SABAM vs. Scarlet decision [1], and concludes that forcing a hosting service to screen all of its users' communications in order to block potentially copyright-infringing content violates EU law and fundamental rights, in particular freedom of expression and privacy. The Court referred in particular to the 2000 Online Services Directive (“eCommerce directive”) and the Charter of Fundamental Rights [2]. As several policy proposals such as ACTA or the upcoming IPRED revision aim at preventing the sharing of culture through a private party enforcement, this decision comes right on time. It clearly states that pushing private companies to monitor and police their networks and services to prevent potential copyright infringements is not compatible with the democratic values of the European Union. “This ruling should sound as a call for EU policy makers to stop pushing for privatized censorship schemes under the guise of ‘cooperation’ between Internet actors and the entertainment industry. We now need to break away from repression, which is bound to undermine our freedoms online and an open Internet, and engage in a profound reform of our broken copyright regime. We must invent a copyright that, instead of censoring the Net, will foster access to culture and sharing while fairly funding creation.”, said Jérémie Zimmermann, spokesperson for the advocacy group La Quadrature du Net. The ECJ ruling the SABAM vs. Netlog case follows a lawsuit introduced in 2009: Belgian copyright collecting society SABAM sued the Belgium-based social networking site Netlog and demanded that Netlog, which qualifies as a hosting service, be forced to install a system to prevent copyright infringements carried on by its more than 2 million Belgian members. The Court of First Instance of Brussels referred the case to the European Court of Justice, asking whether such measure was compatible with EU law [3]. * References * 1. https://www.laquadrature.net/en/eu-court-of-justice-censorship-in-name-of-c… 2. See the ruling: http://curia.europa.eu/jcms/jcms/P_84732/ 3. The full preliminary question was the following: “Is it in conformity with the EU E-Copyright Directive 2001/29, the EU IP Enforcement Directive 2004/48, the EU Data Protection Directive 95/46, the EU E-Commerce Directive 2000/31, the EU Privacy in Electronic Communications Directive 2002/58 and Articles 8 and 10 of the European Convention of Human Rights that EU Member States allow a national court to issue a cease-and-desist order against internet intermediaries the services of which are used by third parties to commit copyright infringement, so that a hosting provider is obliged to install a system for its entire clientèle, which filters all incoming and saved information in order to identify electronic data which contain copyright-protected work and in order to block the further exchange of these files?” ** About la Quadrature du Net ** La Quadrature du Net is an advocacy group that defends the rights and freedoms of citizens on the Internet. More specifically, it advocates for the adaptation of French and European legislations to respect the founding principles of the Internet, most notably the free circulation of knowledge. In addition to its advocacy work, the group also aims to foster a better understanding of legislative processes among citizens. Through specific and pertinent information and tools, La Quadrature du Net hopes to encourage citizens' participation in the public debate on rights and freedoms in the digital age. La Quadrature du Net is supported by French, European and international NGOs including the Electronic Frontier Foundation, the Open Society Institute and Privacy International. ESN-IAMCR CfP Deadline Extension: *February 28th, 2012*
by Francesca Musiani 14 Feb '12

14 Feb '12

Dear colleagues, please note that the deadline for presenting your abstract to the ESN section of the 2012 IAMCR conference has been extended to *February 28th*. Apologies for cross-posting. Regards, Francesca ---- Announcement of Deadline Extension for IAMCR Durban 2012 The deadline for submissions of abstracts of papers and panel proposals for the IAMCR Durban 2012 Conference has been extended to February 28, 2012. This will permit applicants from all continents who could not make the earlier deadline to now submit their abstracts or panels for consideration for Durban. The conference is to be held from July 15-19, 2012 at the Howard College Campus of the University of KwaZulu Natal (UKZN) in Durban, South Africa. The 2012 IAMCR conference will be held under the general theme, 'South-North Conversations'. The theme calls for balanced and empowering narratives between communications thinkers in developing countries, sometimes referred to as the 'global south' and those of the developed countries in the 'north'. It seeks to expose the interactive linkage of ideas and research initiatives within and across development and cultural regions. Participants in the conference will interrogate the compatibilities and disjunctures in media and communication concepts originating respectively from the ‘Global South’ and the 'Global North'. In choosing the theme ‘South-North Conversations’, the conference organisers acknowledge that the ‘South’ has something important to say to the ‘North’, and vice versa, and further that the ‘North’ has something to gain from its relationships with the ‘South’. The concept of 'conversations', indicates peer-to-peer dialogue, and a more interdependent vision of global conceptual engagements. The conference will also seek to explore the varied modalities and technologies of communication, new methods of media flows and of associated identity creation, image-making and perceptions globally. It will examine the diverse forms of technology transfers and literacies from differently-situated regions of the globe, and differently- situated communities within regions, countries or organisations. Contributions from both established researchers as well as from young and emerging scholars are equally encouraged. Selected Issues Some of the sub-themes that lend themselves to exploration across many of the IAMCR Sections and Working groups include: • Revisiting 20th century media and communication constructs • Critically evaluating communications research in the global south • Uneven access to technological, political and social capital • Varied access to information technologies • Alternative media literacies • Issues of the so-called ‘digital divide’ post WSIS • Asymmetrical news and information flows • Trend lines and origins of innovations, apps and new media • The spectre or reality of cultural imperialism: regional, global • Fighting back: empowerment of the local and regional • Local languages – a growth area or reversals in current global media eco-systems • Media development, democracy and ethics • Social media, challenge and advocacy • Users and service providers: north and south • Communication as a tool of empowerment of the marginalised and the stigmatized • Global media hegemony, regional hegemony and counter hegemony • Whose story?: competing historical narratives of communication from the north and south • Any other topic related to the general conference theme Submission of Abstracts Each Section and Working Group of the IAMCR has issued its own Call for Papers, based on the general thematic outline above. The list of Sections and Working Groups and links to their respective Calls may be found at the Conference website below. The deadline extension to February 28 applies to ALL IAMCR Section and Working Groups, and supersedes any prior deadline notations which may appear on some earlier announcements. Abstracts should be submitted only via the central Open Conference System (OCS) at http://iamcr-ocs.org/. Deadlines In light of the new abstracts deadline of February 28, 2012. The OCS system at http://iamcr-ocs.org/ will also close on February 28, 2012. Decisions on acceptance of abstracts will be communicated to individual applicants by their Section or Working Group Heads no later than March 19, 2012. Conference registration will open as originally scheduled on March 12, 2012 for bookings by participants. For those whose abstracts are accepted, full conference papers are to be submitted via the IAMCR OCS by June 10, 2012. Guidelines for Abstracts Abstracts should be between 300 and 500 words in length. http://www.iamcr-ocs.org/ www.iamcr-ocs.org On Tue, Jan 31, 2012 at 6:47 PM, Francesca Musiani <francesca.musiani(a)gmail.com> wrote: > Dear colleagues, > > just a reminder that the deadline for presenting your abstract > proposals for the Emerging Scholars Network section of the 2012 IAMCR > conference is two weeks away, *February 14th*. Rising temperatures are now recognized as a sign of a planet in crisis. Inequities between rich and poor, North and South, grow ever deeper. The global economy has failed in its promise to produce and deliver basic goods in an efficient manner for an expanding population, leaving increasing numbers in abject poverty. The environmental crisis, the equity crisis, and the crisis of distributed production, all have their roots in the current economic system with implications for our culture, our society, and for our health and well-being. What would an economy built on principles of fairness and sustainability look like? How do we model it; where is it emerging; how do we collectively strategize to fully implement it? These are the pressing questions of our time. In response, the New Economics Institute is convening "Strategies for a New Economy," a conference June 8-10th at Bard College on the Hudson River in New York State. It will gather together what are often diverse and scattered efforts to reshape our economic system, place them under one tent, and raise the flag to announce that transitioning to a new economy will mean engaging politicians, researchers, media, educators, citizen activists, business leaders, financial experts, scientists, union workers, cultural leaders, advocates for the disenfranchised, and youth -- all working together to achieve a common goal. The three-day conference will include over 60 workshops, plenary gatherings, and participatory strategizing sessions organized in 10 theme areas (see below). "Strategies for a New Economy" will highlight best research and best practice under each theme and ultimately demonstrate that a decentralized, sustainable, cooperative economy is already taking shape, offering a strategy for action. Registration is now open. http://www.neweconomicsinstitute.org/conference We invite you to be part of the dialogue. Best wishes, Susan Witt on behalf of the staff and board of directors of New Economics Institute www.neweconomicsinstitute.org Strategies for a New Economy Conference Themes 1. Visioning and Modeling the New Economy: Shared Prosperity within Planetary Limits What will a new/green/resilient/just/sustainable economy look like and how do we get there from here? That is the question addressed under this theme, providing a framework, a long view on the subject. Workshops will cover historic examples, systems thinking approaches, economic modeling tools, grass roots community planning, and leadership training for a new economy. 2. Banking and Financing a New Economy: Scale, Criteria, Innovation The current global banking and financing system has failed us, creating havoc with national and regional economies, and leading to real life personal tragedies in lost jobs and lost homes. How might an alternative system be structured that promotes long-term sustainable development rather than short-term value? Presentations will include talks on public, cooperative and community banking, citizen-organized community financing programs, radical impact investing, and the role of government in financial reform. 3. Measuring Well Being: Alternative Indicators of Wealth and Progress Gross Domestic Product (GDP) has long been used by economists to measure wealth and progress, but is it really a measure of our well-being? The presenters on this theme will argue that other factors must be considered to account for ecological health, quality of life, and well being. The workshops will showcase some of the popular alternative indicators, consider how these have been applied at the policy level, and give specific examples of putting these new measures into practice. 4. Messaging the New Economy: Education, Media, Public Campaigns A new economics will require the development of new curriculum material both in content and presentation. It will be multi-disciplined, acknowledging that the transition to a new economy will involve a complex cultural change. It will draw on both the theoretical and practical application. It will be a distributed learning, relying on social media, informal learning circles, and peer education. Where is this new economics training emerging? And relatedly, how best to bring the story of this emerging movement to attention of media and build public campaigns that lead change? 5. Rebuilding Local Economies: Engines for Resilience The Local Economy Movement is considered by many to be the engine of the new economy. Vibrant, energetic, self-empowered, it is driven by citizen activists not waiting for governments to solve problems, but building now the kind of economy they would like for their future. Blossoming out of the local food movement, these local initiatives are supporting multiple kinds of local production to meet local needs. Shaped by local skills and local resources they differ in form from region to region -- but all are characterized by the vision, creativity, and community spirit of its core groups who dare to take risk and try what has not been done before. 6. Reimagining Ownership and Work: Coops, Stakeholders, Corporate Structure When business is owned by capital instead of by workers and stakeholders, an uneven distribution of wealth inevitably occurs. Workshop presenters have both research and practical experience with new ownership models including consumer and producer coops, the Mondragon cooperatives in Spain, the Northern Italian flexible manufacturing networks, Employee Stock Ownership Plans, and multiple stakeholder ownership models, demonstrating how these have contributed to social justice, economic development, secure and fulfilling jobs, and sound management of the commons. 7. Responsive Government for a New Economy: Politics as if People and Planet Mattered Some have said that the biggest hindrance to transitioning to a fair and sustainable new economy is the impasse in our political system, the bickering, the corruption, the cost of campaigns. Panelists in the Responsive Government theme will discuss the forms of governance, participation and action‹at local, national and global levels‹necessary to support the transition to a new economy. Speakers will move from an initial focus on reforming our current government institutions to discussion about deliberative democracy and alternative models of participation and decision-making. 8. Sharing the Commons: Identifying, Allocating, Restoring What is the appropriate place of land and natural resources in a just and sustainable economy? Should land be a commodity traded on the market to the highest bidder, allowing those with ownership to benefit from our common need and common heritage? If not via market, how might land and natural resources be otherwise allocated. 9. Sustainable Production and Consumption: Simplicity, Sufficiency, Abundance While much of the focus of transitioning to a new economy is on changes in government policy, business structure, banking, and financing, there remains a considerable role for individuals and households in this transition. How can we develop mutual support systems that replace our dependence on acquiring more stuff? The elegance of simplicity, the richness of community, living within the bounds of our bioregion, shorter work weeks -- these are all elements of a new American Dream. TimeBanks, meta-currencies, asset-based community accounting, resilience circles -- are all tools for facilitating what will be a social and cultural shift as well as economic. In the process new local forms of production emerge, involving producer and consumer working in association. 10. Transforming Money: Structuring, Issuing and Valuing New Mediums of Exchange Though the tool of money is a social construct, the very form and nature of its current method of issue is rarely questioned when addressing the need to transform our economy to one that is more just and sustainable. What might be sound principles for monetary issue in a new economy? How might the process be more democratized? These are some of the questions discussed under this theme from both a theoretical and applied point of view. Panels will examine the nature of money, its origins, its status as a commodity, and its place in social relationship and language. Other panels will examine specific contemporary examples of regional currencies including BerkShares, WIR, and Chimgauer, and the potential offered by community based electronic platforms to work alongside present currency systems. * * * * * * * To be removed from this eNewsletter list, simply write ³unsubscribe² in the subject line of a return email. _______________________________________________ cc_research mailing list cc_research(a)complementarycurrency.org http://complementarycurrency.org/mailman/listinfo/cc_research_complementary…

Hello, I've just setup diaspora on wwelves.org (so you can just use may email address to add me to your diaspora friends =) I would also like to offer my help with setting up a pod for P2P Foundations, if needed also finding someone to offer server space for it! @franco could we use p2pf.org? this way people using it could have as their identifiers: franco(a)p2pf.org, michel(a)p2pf.org etc... IMHO diaspora already provides quite decent alternative to big brothers like Facebook/Twitter in many aspects... =) ~ elf Pavlik ~
