Mark: You and your compatriots on P2P view the world from revisionism. Go ahead and keep looking through your microscope-provided by your "teachers." Or take the time and read some very old documented evidence available at a library near you= but you may need to stay there awhile on microfiche. -----Original Message----- From: Mark Janssen Sent: Sunday, October 23, 2011 4:39 PM To: P2P Foundation mailing list Subject: Re: [P2P-F] Fw: Info On Sun, Oct 23, 2011 at 10:32 AM, Natalie Golovin <10natalie(a)cox.net> wrote: > The European Tribes treated the Natives no worse than they treated each > other. Whoa. You should really stop talking. You have NO idea what you're talking about. How about forced acculturation, not allowing them to speak their own language (which hold the record of their own history), confined them under threat of violent force into reservations, among other things. But, really, that's probably not even the worst of it -- the worst of it is that for reasons they couldn't ever understand is why you were doing all of these cruel things when they were willing to share it it all with you. Why, when they handed out their hand to be friends, you chopped it off. Remember, they're the ones who gave us Thanksgiving which is still "celebrated" in this nation today. Read the reports made of making first contact with the Native peoples here. You really should read up before propagating the attitudes of conquest. Sorry.... marcos _______________________________________________ P2P Foundation - Mailing list http://www.p2pfoundation.net https://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation

Fwd: Year-End Roundup: In 2016, The World Passed The Tipping Point Into A Perilous New Era

the global elite (see the editorial board <g>) on the revolt against the global elite ? ---------- Forwarded message ---------- From: The WorldPost <highlights(a)theworldpost.com> Date: Sat, Dec 31, 2016 at 7:01 PM Subject: Year-End Roundup: In 2016, The World Passed The Tipping Point Into A Perilous New Era To: michel(a)p2pfoundation.net Year-End Roundup: In 2016, The World Passed The Tipping Point Into A Perilous New Era A search for identity amid the swell of anonymous forces from globalization to technology drove this year’s anti-elite political upheaval. By: Nathan Gardels, Editor-in-chief Visit the WorldPost at http://www.theworldpost.com <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> Last year, we were on the cusp. This year, we’ve gone over. In the 2015 WorldPost Year-End Roundup <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, we observed that we were then “on the cusp of a tipping point” in the race between a world coming together and one falling apart. In 2016, we have indeed tipped over into a new era. The profound upheavals of this year were anticipated in an essay we published in March titled “Why the World Is Falling Apart <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>.” In that piece I wrote, “The fearful and fearsome reaction against growing inequality, social dislocation and loss of identity in the midst of vast wealth creation, unprecedented mobility and ubiquitous connectivity, is a mutiny, really, against globalization so audacious and technological change so rapid that it can barely be absorbed by our incremental nature. In this accelerated era,” I continued, “future shock can feel like repeated blows in the living present to individuals, families and communities alike.” Revolt Against Global Elites Brexit shocked the world, but it wasn’t 2016’s only rebellion. Economics and technology forged the worldwide convergence we have seen with globalization over recent decades. But as people lose any sense of control over their fate in this process, culture and politics engender the opposite ― a divergent search for shelter in the familiar ways of life that register a dignity of recognition among one’s own kind and constitute identity against the swell of anonymous forces. The determination to “take back control” across the Western democracies among those dispossessed by change was explosively expressed in 2016 in a widespread revolt against the elite custodians of the status quo through Brexit, the Trump victory and the ongoing anti-establishment insurgency in Europe. The “Great Reaction of 2016” may well have been justified because of the decay of democracies captured by organized special interests. Too many were left behind by unresponsive insiders. Yet the populist character of this political awakening threatens more chaos ahead rather than fixing what ails today’s vexed societies. “Populism appeals to the ‘will of people,’ Julian Baggini <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> wrote in a piece for us last year, “but is actually profoundly undemocratic. Democracy is about the negotiation of competing interests, the balancing of different values. Populism, in contrast, is a kind of mob rule. Where there is complexity, it offers simple solutions. Instead of seeking common ground, it looks to exaggerate the differences between them and us. The unquestioned righteousness of its own cause and means to its ends leads to the demonization of those it opposes.” The Turn Toward Autocracy and Nativism A summer coup attempt in Turkey this year tested President Recep Tayyip Erdoğan. The close cousin of populist politics is the affinity for rule by strongmen who fashion themselves as tribunes of the people. In the wake of the coup attempt in Turkey earlier this year, Turkish President Recep Tayyip Erdoğan has tightened the screws in the place once thought to be the model of democracy with Islamic characteristics. In an interview right after the failed coup, Turkish novelist Elif Shafak <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> lamented the new course of events: “There was already a rise in illiberal democracy in Turkey. There was already a rise in authoritarianism. The country was already sliding backwards <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> and now this! The ballot box in itself,” she said in words that apply to the West as well, “is not enough to render a system a ‘democracy.’ A true democracy needs separation of powers, rule of law, freedom of speech, women’s rights, LGBT rights, free and diverse media and independent academia. Without all these institutions and values you can only have ‘majoritarianism.’ And majoritarianism is not the same thing as democracy.” Writing from New Delhi, Shashi Tharoor <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> placed a similar slide in India toward autocratic rule, intolerance and nationalist assertion in the global context: “The global backlash against the forces that have defined the first decade and a half of the 21st century has taken on a nativist hue everywhere,” he said. “In Europe and America, this has involved racist hostility to immigrants and minorities (whether ethnically or religious defined). In India, too, the ruling party rose <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> through demonizing Muslims and stigmatizing political and social dissenters. Since such negative messaging requires a positive counterpart, nationalism has filled the breach, as a majoritarian narrative has sought to subsume each country’s diverse political tendencies into an artificial mandated unity masquerading as patriotism.” Social Media, Russian Hacks and Surveillance Capitalism Rising social media and its disconnect with historically elite intellectual institutions played a significant role in events this year. The newfound prevalence of social media has been part and parcel of this year’s momentous shift. As we reported in our 2016 Global Thought Leaders analysis <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, the passionate political environment of 2016 appears to have marked the inflection point when the influence of individuals sharing information with their peers on social media surpassed that of established media platforms. “This shift matches the inversion <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> of the old pyramid in which the authority and influence of elites in both society and the media held the most sway over the majority of the population,” we noted <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> in early December. “The separation of authoritative knowledge from influence in a world where the social medium is not only the message, but the route to power,” we continued, “is a menacing turn for society.“ The internet activist Wael Ghonim <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, whose Facebook posts helped spark the Arab Spring in Egypt, concurs. While social media did not create the passions behind hate speech and intolerance, he said in a WorldPost interview in October, “there is no doubt that the algorithmic structure of social media amplified and abetted the turn to mobocracy. The internet has empowered the masses and introduced a more decentralized medium for communicating with each other.” But,” he asked, “is this so-called ‘liquid democracy <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>’ without any form of meritocracy that sorts out the wheat from the chaff a good thing for society?” For Ghonim, the spread of a post-fact discourse of peer-driven mobocracy creates a new challenge. “While once social media was seen as a liberating means to speak truth to power,” he said, “now the issue is how to speak truth to social media.” A related, and equally menacing, facet of the incoming era is the emergence of a new “code war” <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> that reached fresh heights this year through Russian influence meddling in the U.S. presidential election. Writing from Moscow, Fyodor Lukyanov <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> reflected that the U.S. is just now getting a taste of its own medicine after intervening in other countries, including by trying to influence democratic elections, for decades*. * Zbigniew Brzezinski <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> has no doubts Russian President Vladimir Putin was directly involved in seeking to influence the U.S. election since he is in absolute control of the state, including the intelligence agencies. While acknowledging the U.S. has meddled for years in other democracies, Brzezinski nonetheless recognized that, “The new methods give activities of this sort a wider scope than ever before. And thus they are indeed more influential and effective than ever before. That is new and, of course, deeply troubling.” Toomas Ilves <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, the former president of Estonia, expects more cyberattacks from Russia as elections loom in Europe in the coming year. “The conundrum that Europe will face,” he wrote from Tallinn recently, “is whether or not to use illiberal methods to safeguard the liberal state. … Because of cyberattacks and fake news, we can already imagine the problem all democratic societies will face in future elections: how to limit lies when they threaten democracy.” Oliver Stone <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, who is preparing a new film based on his conversations with President Putin, has his doubts about Russia’s involvement. But he, too, agreed that we are now embarked on a “digital arms race” due in his view to the first use by the U.S. of offensive digital weapons, like the Stuxnet virus that disabled <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> Iran’s nuclear centrifuges. In a WorldPost interview in September that focused mostly on his film “Snowden,” the Hollywood director worried as much about the invasion of privacy by the private sector as by the state. “Companies like Google profit enormously from data mining <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> of your personal searches, behavior and habits,” he said. “There is more money in selling that data than in selling a product. It’s surveillance capitalism. It really is a new kind of totalitarianism.” AI, Algorithms and the Religious Imagination AI continued to advance in 2016. Another game-changing development in technology that continued to advance rapidly in 2016 is artificial intelligence, or AI. In April, the Berggruen Institute gathered top scientists and philosophers in Palo Alto to discuss the promises and perils of AI. While many saw enormous benefits in the short term, for example through the diagnostic capacity of big data for health care, the longer term was more concerning. Bill Joy <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, who helped develop the “Java Language Specification” software, warned, as but one example, that sophisticated new gene editing technology has the potential to “eliminate genetic diversity.” *Sapiens* author Yuval Harari <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>followed up this theme in an interview we published in May: “The whole of science is converging on this master idea of processing data in an algorithmic way, and this will cause the whole of economics and politics to converge on the same idea,” he argued. “The whole of biology since Darwin can be summarized in three words: ‘Organisms are algorithms.’ Simultaneously, computer scientists have been learning how to create better and better electronic algorithms. Now these two waves … are merging around this master concept of the algorithm, and their merger will create a tsunami that will wash over everything in its way.” In a reflection on the peril to the person from these developments, neuroscientist Antonio Damasio <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> vigorously resisted the idea that being can be reduced to an algorithm. In a related essay <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, I pondered how scientific advances are resurrecting the religious imagination. “The more scientific discovery reveals,” I wrote, “the more we realize it can’t answer the great existential questions.” Interdependence Works Both Ways Host of the Olympics this year, Brazil was in the global spotlight for more than just games. 2016 also demonstrated just how connected the world really is. We saw how China’s economic slump is testing Brazil’s democracy. The deep recession there due to slack demand <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> by China for the South American nation’s commodities exposed the political cracks in the system, illustrating that the interdependence which giveth can also take away. As the revered former president of Brazil, Fernando Henrique Cardoso <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, wrote in the wake of the now-ousted President Dilma Rousseff’s impeachment, the cracks in the country’s democracy result from the same causes as in the advanced nations. “At the core of this crisis is the widening gap between people’s aspirations and the capacity of political institutions to respond to the demands of society,” he wrote. “It is one of the ironies of our age that this deficit of trust in political institutions coexists with the rise of citizens capable of making the choices that shape their lives and influence the future of their societies.” In another example of how what happens in one part of the world impacts others far away, the recapture of Aleppo by Syrian President Bashar Assad and his Russian allies in December after years of horrific civil war coincided with the Christmastime attack in Berlin <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> by a suspect who was believed to be an asylum-seeker with ties to Islamist terror groups. This tragic event likely tipped the scales decisively in favor of anti-European Union and anti-immigrant political forces which have been gaining momentum in reaction to the massive refugee influx, including of Syrians fleeing the carnage at home. As a WorldPost editorial <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> summarized the situation: “The European idea, which has been losing luster for years, looks to be the latest and most consequential casualty of a world in turmoil that stretches from the rubble of Aleppo to the World War II memorial ruins of the Kaiser Wilhelm church, near where the Christmas market attack took place in Berlin.” *Where Hope Remains * While politics divided us in 2016, others reminded us of our shared humanity. The temptation to blame refugees for Europe’s woes must take in the broader picture, Pope Francis told our outgoing Vatican correspondent Sébastien Maillard <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, in an interview. He called on Europe to “rediscover its capacity to integrate” plural cultures. But the Holy Father didn’t mince words about the dynamic he sees behind terrorism and the refugee crisis. “In the face of Islamic terrorism,” he told Maillard, who is also an editor of Le Croix, “it would therefore be better to question ourselves about the way in [which] an overly Western model of democracy has been exported to countries such as Iraq, where a strong government previously existed. Or in Libya, where a tribal structure exists. We cannot advance without taking these cultures into account. As a Libyan said recently, ‘We used to have one Gaddafi, now we have 50.’” When politics divides instead of unites, walls off instead of embraces, spiritual authorities like Pope Francis and artists or musicians like Yo-Yo Ma step into the breach to sustain our humanity. As we wrote <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> in June, highlighting the release of the Silk Road Ensemble documentary, “The Music of Strangers,” <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> the famed cellist is the pope’s spiritual cousin in this cause, sounding the healing chord of fellowship instead of enmity. More than a musician, he, too, is a guiding spirit who rises to the challenge of a world unraveling. “To be able to put oneself in another’s shoes without prejudgment is an essential skill,” Yo-Yo Ma once told <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> The WorldPost. “Empathy comes when you understand something deeply through arts and literature and can thus make unexpected connections. These parallels bring you closer to things that would otherwise seem far away. Empathy is the ultimate quality that acknowledges our identity as members of one human family.” Finally, this year we celebrated Charles Taylor, who was awarded the 2016 Berggruen Prize for ideas that shape the world, as the “anti-xenophobe philosopher <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>.” In an overview, Berggruen Institute president, Craig Calhoun <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…>, summarized the key works of the Canadian philosopher. And in a related editorial we wrote <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> about how the man is an important figure for our time, and indeed, for this year: “It is Taylor’s thinking on the recognition of irreducible diversity in an interdependent world of plural identities ― and how societies can cope with this reality ― that gives him urgency in this era of Trump, Brexit, the burkini ban and the rise of the anti-immigrant right in Europe.” Introducing the WorldPost - Where the World Meets [image: Introducing%20The%20WorldPost%20-%20Where%20the%20World%20Meets] <http://r20.rs6.net/tn.jsp?f=001aiMFszI3OGG0-QPBUfsUpq-gtC49aXvytAf0fvXovLiU…> WHO WE ARE EDITORS: *Nathan Gardels*, Co-Founder and Executive Advisor to the Berggruen Institute, is the Editor-in-Chief of The WorldPost. *Kathleen Miles *is the Executive Editor of The WorldPost. *Farah Mohamed* is the Managing Editor of The WorldPost. *Alex Gardels* and *Peter Mellgard *are the Associate Editors of The WorldPost. *Suzanne Gaber *is the Editorial Assistant of The WorldPost. *Katie Nelson* is News Director at The Huffington Post, overseeing The WorldPost and HuffPost’s news coverage. *Nick Robins-Early* and *Jesselyn Cook* are World Reporters. *Rowaida Abdelaziz *is World Social Media Editor. Fwd: The Struggle for Meaningful Work (GTN Discussion)

---------- Forwarded message ---------- From: Great Transition Network <gtnetwork(a)greattransition.org> Date: Sat, Dec 31, 2016 at 3:27 AM Subject: The Struggle for Meaningful Work (GTN Discussion) To: michelsub2004(a)gmail.com >From Paul Raskin <praskin(a)tellus.org> ------------------------------------------------------- Dear Great Transition Network, As we bid adieu to 2016, a banner year for the Fortress World scenario, what can we do but turn with renewed resolve to the work of transition? There is no alternative (to hijack TINA, Margaret Thatcher’s infamous justification for neoliberalism). Anyway, the work itself is a privilege and a gratification. This brings me to the topic of our JANUARY discussion: “The Struggle for Meaningful Work.” Kent Klitgaard’s Viewpoint, so titled, argues that the degradation of work, like the degradation of community and the environment, is inherent in the logic of capital accumulation, but receives insufficient attention. The struggle for meaningful jobs, he contends, ought to stand alongside parallel struggles for justice, equity, and sustainability as core components of a transformative praxis. Kent’s thoughtful piece is inspired by his own search for meaningful work in a career that has spanned cabinet-making to ecological economics. It highlights a critical dimension of a Great Transition that warrants heightened emphasis, or so it seems to me. Do you agree? Would you revise its formulations? Please read it at www.greattransition.org/ publication/meaningful-work, and share your thoughts. This Viewpoint will be published in February, along with selected comments drawn from the forthcoming discussion and an interview with Nancy Folbre on “The Caring Economy.” Comments are welcome through JANUARY 31. Warm wishes to you and yours for a healthy and meaningful 2017. Looking forward, Paul Raskin GTI Director ------------------------------------------------------- Hit reply to post a message Or see thread and reply online at http://greattransition.org/forum/gti-discussions/187-the- struggle-for-meaningful-work/2194 Need help? Fwd: [opennetcoalition] ePrivacy: unraveling the lobbies' falsehoods

---------- Forwarded message ---------- From: La Quadrature du Net <contact(a)laquadrature.net> Date: Fri, Dec 9, 2016 at 12:05 AM Subject: [opennetcoalition] ePrivacy: unraveling the lobbies' falsehoods To: opennetcoalition(a)laquadrature.net Press Release *Tags :* EPRIVACY, PRIVACY, EUROPEAN UNION La Quadrature du Net — For immediate release Permanent link: https://www.laquadrature.net/en/ePrivacy-unraveling-the- lobbies-falsehoods ePrivacy: unraveling the lobbies' falsehoods Paris, 8 December 2016 — *The review of the European ePrivacy directive <http://eur-lex.europa.eu/legal-content/fr/TXT/?uri=CELEX:32002L0058> on the confidentiality of electronic communications may not have reached the limelight yet, but this doesn't mean that the influence work and the fight over interests haven't started. On the contrary, as the draft text is tabled by the European Commission to be published in January 2017, interest groups are at the doors of the European executive power to get their two cents in the upcoming text.* To get an idea of the content of the discussion happening in high places, we just need to read the open letters, the position papers and others common declarations <https://www.telefonica.com/en/web/public-policy/blog/article/-/blogs/joint-…> of ETNO <https://etno.eu/>, GSMA <http://www.gsma.com/>, DIGITALEUROPE <http://www.digitaleurope.org/> and other lobbies of the digital and telecom industries: all call for the plain and simple repealing of the directive. Much as during the negotiations for the General Data Protection Regulation (GDPR), expounding our arguments is not enough in the face of the industry's means and striking capacity, we need to review and examine all their misleading arguments, one by one. Argument #1 : The ePrivacy directive adds legal and regulatory complexity when we should be “restoring user trust by decreasing the regulatory complexity”[1 <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> ] What we have here is the magic of the “rationalisation” argument at work. This logic suggests that the regulatory environment is a too big constraint for companies and that it should be simplified. However, it bears reminding that to “simplify” should never mean to weaken and least of all to delete guarantees that protect users. Furthermore, this constraint is essential in order to oversee the practices of companies for whom our personal data represents a gold mine and is often the basis of their business model. The “Laissez-faire” and “self-regulation” approaches, constantly advocated by the industry, are lures that have never brought individuals more protection and confidentiality. Regulations exist to make services providers and other actors respect basic rules in terms of security, confidentiality and privacy. Wherever there is no clear regulation, their practices tend to be more exploitative of our privacy for commercial gain. Likewise, users must be able to know globally what are their guarantees and their rights: as we use tens of different services everyday, it is absolutely necessary to have a common base of guarantees that allows us to know what to expect. ------------------------------ Argument #2: The ePrivacy directive is rendered obsolete by the new General Data Protection Regulation.[2 <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> ] This is the industry's main argument: the new GDPR regulation would already cover almost all of the ePrivacy's provisions and this directive would therefore now be unnecessary. As a reminder, the ePrivacy directive is intended to protect privacy and data confidentiality *in the area of electronic communications*. That is to say, is is intended mainly for communications such as instant messaging, SMS, VoIP communications like Skype, emails, phone calls, etc., for which it will determine obligations for service providers in terms of security and confidentiality. The General Data Protection Regulation adopted in April 2016 and which will enters into application in May 2018 intends, on the other hand, to guarantee the protection of personal data for each individual when this data is used by private corporations as well as public authorities. Recent technological developments have been such that the majority of transfers and movement of personal data now happens on the Internet via the many websites and services we access. Both texts are therefore not equivalent: one –the Regulation– focuses on the personal data produced by our use of services, the other –the ePrivacy directive– focuses on respecting our privacy and the confidentiality of our exchanges with other parties. The adoption of this new Regulation in April 2016 does not make the ePrivacy useless in any way. Indeed, it does not cover directly some fundamentals rights such as the right to communicate freely or the right to privacy. Furthermore, the ePrivacy directive covers issues that goes beyond personal data and that are not covered by the Regulation. It is the case, for instance, for unsolicited communications like spams or direct prospecting. Because they are pervasive in our daily lives and because the informations they convey are of great value, electronic communications require a specific security and confidentiality regime, as protective as possible. The revision of this directive is a huge opportunity to strengthen this protection while still remaining perfectly consistent with the general legislation enshrined in the future Regulation. ------------------------------ Argument #3: User privacy protection is already guaranteed by the Regulation, it is not necessary to keep article 5(3) on the confidentialiy of your device. [3 <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> ] The ePrivacy directive was amended in 2009 and a 3rd paragraph on the confidentiality of “terminal device” (your phone –smart or not– or your computer) was added. It oversees “information storage” and “access to already stored information on the terminal device” (such as cookies), by submitting them to the consent of the user. Today, it is poorly implemented by Service Providers who make consent not only compulsory to access a service (destroying the “freely given” nature of this consent; it is essential to ban this practice) but also uninformed because it is drowned in an incomprehensible amount of information. In this, the article 5.3 failed to give the control of their data back to the users but remains a crucial tool, both essential to limit the effect of online tracking and unique, as nothing alike exists in the General Regulation. This article on the confidentiality and the integrity of terminal devices therefore needs to be rephrased in order to improve its implementation, but its scope must also be widened to include cases where the device creates information by default such as tracking using canvas fingerprinting <https://fr.wikipedia.org/wiki/Canvas_fingerprinting>. All in all, privacy protection must include the confidentiality and the integrity of users' device. This article is thus essential but can be updated and made more efficient by widening its scope and reinforcing the guarantees for the users (which is exactly what industries do not want). ------------------------------ Argument #4: Online communication services are not covered by the directive. Thus, according to telecom operators: A “level playing field” for all actors must be created. Because they are at a terrible disadvantage compared to American service providers [4 <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> ] It is true that some services that are ubiquitous today, such as online messaging services such as Whatsapp, Signal, Viber (also called “OTT”: over-the-top services), did not exist when the ePrivacy directive was adopted in 2002 and are not subject to the security and confidentiality requirements of the ePrivacy directive. On this issue, telecom operators and lobbies of the digital industry have developed a facade of opposition. When operators denounce the unfairness they face regarding new online services, these reply that they are already covered by the General Regulation. In reality, far from being opposed to each other, they all reach a common conclusion: the necessary abrogation of the directive. It is a nice trick on their part but a vain attempt in the end as the issue of the directive's scope should be fixed beforehand by the new European electronic communication code <https://www.laquadrature.net/en/%E2%80%9Dhttp://www.europarl.europa.eu/oeil…>, currently being discussed in the European parliament. It should modify the definition of “electronic communication services” to add new players such as online messaging services. Security and confidentiality obligations must apply to all service providers and in a equal way. Treating all operators, new online services and future services equally is necessary in order to be able to develop more ambitious rules about the confidentiality and security of our electronic communications. ------------------------------ Argument #5: The derogations left to member States for national security purposes are too broad and endanger the possibility for service providers to offer some services, such as end-to-end encrypted electronic messages. [5 <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> ] Because of the Article 15.1, Member States do have the ability to limit the confidentiality and security requirements laid down in this directive for national security, defense or public security purposes. They may therefore adopt measures providing for the retention of data (such as France with article 6 of the 2004 law regarding Confidence in the Digital Economy or with decree n°2011-2019 of 25 February 2011) which run not only contrary to the EUCJ's decision of 8 April 2014 <http://curia.europa.eu/jcms/upload/docs/application/pdf/2014-04/cp140054en.…> in the case Digital Rights Ireland, but are also conflicting with some technologies that service providers may offer such as end-to-end encryption tools. These very broad derogations left to Member States are therefore incompatible with high security and confidentiality requirements for our electronic communications. This may explain why industry lobbyists, such as DIGITALEUROPE, strongly oppose an extension of the text's scope to OTTs, since article 15.1 would compromise the ability of these services to guarantee security and confidentiality of communications through encryption. This is why there is a real need to question these broad derogations left to Member States for purposes as open and vague as “national security” and to drastically reduce the scope of article 15.1. To this end, the wording “measures providing for the retention of data” must be deleted. Furthermore, it is essential to specify that any national surveillance law falling within these derogations must be both targeted and enforced under prior control of a judicial authority. To reinforce the right to privacy and to reassure service providers and users, La Quadrature du Net recommends the introduction of a separate article on the importance of encryption technologies. It could mention on one hand the essential role of encryption for the security and confidentiality of electronic communications and, on the other hand, remind service providers and Member States of their responsibilities in the promotion of the use of these technologies. ------------------------------ Argument #6 You will kill competitiveness!!! [6 <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> ] This argument, made nearly empty by how commonplace it is in the jargon of industry lobbyists, means that forbidding the development of certain practices or technologies considered as intrusive for privacy would put the European Union at a disadvantage because other States do not have such constraining regulations. But today, users are more and more aware of what their personal data represents to them and some are turning to more privacy-respecting services. It is useless to hope to be competitive by engaging in the race to ever more intrusive tracking models, we must meet the challenge that lies ahead and see in an ambitious and privacy-respecting regulation the necessary incentive to the egregiously sought-after innovation. But this change of orientation and change of companies' economic model will no happen thanks to free market competition. Without strong and ambituous regulation, companies will never accept to risk their immediate profit. The revision of the ePrivacy directive is the perfect occasion to promote this ideological turning point of which the digital economy is in dire need. - 1. <https://www.laquadrature.net/en/ePrivacy-unraveling-the-lobbies-falsehoods#…> “Building consumer trust by reducing regulatory complexity”. Fwd: Galicia/Northern Portugal; this winter

---------- Forwarded message ---------- From: Mathijs de Bruin <mathijs(a)dsrp.eu> Date: Fri, Dec 9, 2016 at 4:31 AM Subject: Galicia/Northern Portugal; this winter To: Dear friends, As you might know, by now, after two years of intense travelling it is now time to ‘settle down’. At least for a while, potentially permanently. It is, as of now, our intention to rent a large house in the countryside of Galicia or Northern Portugal starting February for at least 3 months. The house would be big enough for you to join, or there will be the possibility to rent neighbouring property. The idea is to create a temporary community, in preperation of a permanent settlement. There, or somewhere else. It would be an intense (but peaceful, tranquil) period of deepening understanding of the local environment, of exploration of actual community formation and the concretisation of ‘what we would be doing there’. Creating roadmaps, connecting people and initiative, getting acquaintant with the land, people and local governments. Exploring funding options, (regenerative) business models based on social, economic and ecological emancipation. All that plus everything The Good Life has to offer; plenty of time, play and imagination. As there are many places to consider (there are similarly abandoned ruralities in most sides of the continent), I have found myself forced to pick one. Amongst reasons, the current choice ‘felt good’. Moreover, particularly Northern Portugal has some favorable conditions: - Wet climate (reduced risk of desertification) - Open culture (internationally oriented, warm towards foreign elements) - Sustainable policy (conservation of natural resources, seperating garbage, profitability of solar) - Good connectivity (4G widely available, cheap) - Airports and cities nearby (Porto, Vigo) - Affordable (some of the lowest land/house prices of the E.U.) Concretely, we hope to make living in this temporary settlement possible on a cost-sharing basis, where costs for ‘good living’ (housing, food, drinks, internet, occasional transport) should round up to a total of about € 300 per person (depending on circumstances). We aim for people staying either a few days or a minimum of one month, to ascertain some stability in the social dynamics. We, at this point me and my partner Irina, will be driving toward Galicia at the start of Februari. Having arrived, we hope to find a furnitured house within several weeks, the scale and details of which depend, partly, on your pledges and/or entausiasm for the project. If you are enthusiastic, interested, have questions or think this *really* is the wrong way, don’t hesitate to contact us. We love to talk and greatly appreciate your feedback. Warm regards, Mathijs P.S. Should you know of any rural villa’s or appartments for mid- or long-term rent in the *North* of Portugal or in Galicia, let us know! — Decentralized Society Research Project http://dsrp.eu / http://dsrp.eu/hackpad mathijs(a)dsrp.eu +31 6 44 838 131 -- Check out the Commons Transition Plan here at: http://commonstransition.org P2P Foundation: http://p2pfoundation.net - http://blog.p2pfoundation.net <http://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation>Updates: http://twitter.com/mbauwens; http://www.facebook.com/mbauwens #82 on the (En)Rich list: http://enrichlist.org/the-complete-list/
