Fwd: [fcf_discussion] ACTA's Impact on Industry and Human Rights - Letters to EU Parliament

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Mon, Oct 10, 2011 at 10:47 PM Subject: [fcf_discussion] ACTA's Impact on Industry and Human Rights - Letters to EU Parliament To: fcforum_discussion(a)list.fcforum.net La Quadrature du Net - For immediate release Permanent link: http://www.laquadrature.net/en/actas-impact-on-industry-and-human-rights-le… ACTA's Impact on Industry and Human Rights - Letters to EU Parliament *** La Quadrature du Net has written to two key committees of the European Parliament regarding the Anti-Counterfeiting Trade Agreement (ACTA). As the EU Parliament engages in preparatory works in view of its upcoming consent vote on ACTA, La Quadrature stresses that the Parliament must fully assess the dangers of this agreement for innovation, competition and competitiveness of EU businesses, but also for human rights. *** ACTA's flaws and dangers should prompt the committee on Industry, Transport and Research committee (ITRE) as well as the Civil Liberties committee (LIBE) to issue opinions on ACTA [1]. Today, La Quadrature du Net has sent letters to these key committees, urging them to undertake a comprehensive assessment of ACTA. *** Letter to the ITRE commitee *** Dear member of the ITRE committee, As you know, the European Parliament will soon be asked to give its consent to the Anti-Counterfeiting Trade Agreement (ACTA). We ask your committee to weigh in this process by working on an opinion regarding the proposal for a Council decision on the signing and conclusion of ACTA. Indeed, ACTA raises crucial questions regarding innovation and competitiveness of EU companies that deserve special scrutiny from your committee, before the Parliament decides whether to grant its consent to ACTA. EU academics and an independent study commissioned by the INTA committee both show that ACTA goes further than current EU acquis, especially regarding border measures, damages and criminal sanctions. Such draconian measures will create a strong legal uncertainty for businesses operating in the EU, and will undermine the realisation of EU objectives in the field of innovation and development of the digital economy, access to medicines or the diffusion of green technologies. Furthermore, given that neither the biggest emerging economies (China, India, Brazil) nor even the United States will ratify ACTA, competitiveness risks being severely hurt. Innovation and competition will be hampered by the implementation of new extremist IPR provisions, undermining the EU's stance in the global economy. We therefore call on you to use your competency and expertise in industrial policy to assess the risks attached to the EU ratification of ACTA. Sincerely, Philippe Aigrain, Gérald Sédrati-Dinet, Benjamin Sonntag, Jérémie Zimmermann Co-founders of citizen advocacy group La Quadrature du Net *** Letter to the LIBE commitee *** Dear member of the LIBE committee, As you know, the European Parliament will soon be asked to give its consent to the Anti-Counterfeiting Trade Agreement (ACTA). We ask your committee to weigh in this process by working on an opinion regarding the proposal for a Council decision on the signing and conclusion of ACTA. Indeed, ACTA raises crucial questions regarding civil liberties of EU companies that deserve special scrutiny from your committee, before the Parliament decides whether to grant its consent to ACTA. As a group focusing on Internet policy, we are particularly worried by the provisions of the digital chapter, that open the door for yet another attack on the rights and freedoms of Internet users in the name of an obsolete copyright regime. We are not alone in alerting about this risk. The Mexican Congress has recently stated that this chapter could lead to a privatised online censorship, with harmful effects on Net neutrality (and therefore freedom of expression), access to communications or access to culture. Frank La Rue, the United Nations Rapporteur on freedom of expression, also expressed similar concerns. Furthermore, the Green group of the EU Parliament commissioned an impact assessment of ACTA on fundamental freedoms which stresses that ACTA's provisions "either eliminate safeguards existing under international law or, after strengthening enforcement measures, fail to introduce corresponding safeguarding measures." It also contradicts the Commission's claim that ACTA does not go beyond the acquis communautaire, stressing that ACTA "will directly or indirectly require additional action on the EU level". We therefore call on your committee to give a thorough and objective assessment of ACTA's compatibility with the EU's commitment to defending and promoting human rights. Sincerely, Philippe Aigrain, Gérald Sédrati-Dinet, Benjamin Sonntag, Jérémie Zimmermann Co-founders of citizen advocacy group La Quadrature du Net * References * 1. So far, the lead committee is the INTA committee (International Trade). The JURI committee (Legal Affairs) and the DEVE committee (Development) will issue opinions. see ACTA's procedure file. ** About la Quadrature du Net ** La Quadrature du Net is an advocacy group that promotes the rights and freedoms of citizens on the Internet. Fwd: [opennetcoalition] No Privacy Without Net Neutrality
by Michel Bauwens 12 Oct '11

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Wed, Oct 12, 2011 at 9:49 PM Subject: [opennetcoalition] No Privacy Without Net Neutrality To: opennetcoalition(a)laquadrature.net La Quadrature du Net - For immediate release Permanent link: http://www.laquadrature.net/en/no-privacy-without-net-neutrality No Privacy Without Net Neutrality *** Brussels, October 12th, 2011 - In a ground-breaking opinion on Net neutrality, the European Data Protection Supervisor stresses that restrictions to Internet access inevitably harm privacy. As the European Parliament enters in the final stage of the negotiations on its resolution on Net neutrality, this opinion underlines that the EU Commission's "wait and see" approach is bound to fail and is unjustifiable. Members of the EU Parliament must preserve citizens' privacy by requiring strong regulatory measures to ban discrimination of online communications. *** In this opinion on Net neutrality [1], the European Data Protection Supervisor (EDPS) makes clear that the protection of Net neutrality is necessary to ensure the confidentiality of communications. According to the EU privacy watchdog, traffic management practices that are not strictly necessary to ensure the network's security or integrity amount to a global monitoring and inspection of users' communications, thereby undermining privacy. To respect current data protection laws, the EDPS stresses that users must give explicit consent to their Internet communications being monitored and restricted. It further stresses that users should always have the choice between a restricted offer and neutral Internet access, without being imposed higher costs by telecom operators. These conclusions blow in pieces Commissioner Neelie Kroes' "wait-and-see" approach based on "transparency" [2] in contracts is enough to protect users against restrictions of their Internet access. "The EDPS demonstrates that any discrimination between Internet services, protocols, sources or contents imposed by telecom operators inevitably hurts the confidentiality of communications. It is therefore the duty of the Members of the EU Parliament to protect privacy by departing from Commissioner Kroes' failed "wait-and-see" approach. The Parliament must require concrete legislative measures to ensure Net neutrality, therefore protecting EU citizens privacy, freedom of expression, as well as innovation and competition online", concludes Jérémie Zimmermann, spokesperson of the citizen adovacy group La Quadrature du Net. ** Key quotes from the EDPS opinion ** Net neutrality violations harm privacy: "Inspection techniques based on traffic data and inspection of IP payloads, i.e. the content of communications, may reveal users’ Internet activity: websites visited and activities on those sites, use of P2P applications, files downloaded, emails sent and received, from whom, on what subject and in which terms, etc. ISPs may want to use this information to prioritise some communications, such as video on demand, over others. They may want to use it to identify viruses, or to build profiles in order to serve behavioural advertising. These actions interfere with the right to the confidentiality of communications". (§78) Failure of mere transparency: " Individuals' consent would not be freely given if they had to consent to the monitoring of their communication data in order to get access to a communication service. This would be even more true if all providers in a given market were to engage in traffic management for purposes that went beyond security of the network. The only option left would be not to subscribe to an Internet service at all. Given that the Internet has become an essential tool both for work and for leisure purposes, not subscribing to an Internet service does not constitute a valid alternative. The result would be that the individuals would have no real choice, i.e. they would not be able to freely give consent". (§55) Access to neutral Internet is crucial: "The EDPS considers that there is a clear need for the Commission and national authorities to monitor the market, particularly to ascertain whether this scenario - i.e. providers linking telecommunication services to communication monitoring - becomes mainstream. Providers should offer alternative services, including an Internet subscription not subject to traffic management, without imposing higher costs to individuals". (§56) Recommended policy steps: "(...). From a data protection and privacy perspective, the scenario where ISPs engage on a routine basis in traffic management policies offering subscriptions based on filtering access to content and applications, would be highly problematic. If this were ever to happen, legislation would need to be put in place to address this situation". (§84). Note: Actually, evidence suggests that telecom opertors already engage in such harmful practices. See the reporting platform RespectMyNet.eu * References * 1. http://www.edps.europa.eu/EDPSWEB/webdav/site/mySite/shared/Documents/Consu… 2. The recently revised Telecoms Package states that operators should inform users about access restrictions. This "transparency" has been taken as a pretext for inaction by pseudo liberals. According to them, citizens can "vote with their feet" and choose between different restricted offers. The EDPS just proved that this approach fails to respect EU privacy law. ** About la Quadrature du Net ** La Quadrature du Net is an advocacy group that promotes the rights and freedoms of citizens on the Internet. Fwd: EU Governments Oppose an Open Wireless Infrastructure
by Dante-Gabryell Monson 12 Oct '11

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Tue, Oct 11, 2011 at 11:06 AM Subject: [fcf_discussion] EU Governments Oppose an Open Wireless Infrastructure La Quadrature du Net - For immediate release Permanent link: http://www.laquadrature.net/en/eu-governments-oppose-an-open-wireless-infra… EU Governments Oppose an Open Wireless Infrastructure *** Paris, October 11th, 2011 - As the European Union engages in important discussions on the future of the radio spectrum policy - i.e the future of open wireless communications -, it's becoming clear that national governments are aligned on the position of dominant telecom operators. To protect open wireless communications operated and controlled by citizens, the EU Parliament must resist the pressure and defend its position. *** Last Spring, in its vote on the Radio Spectum Policy Programme (RSPP), which aims at harmonising wireless communications policies at the EU level) [1], the Parliament affirmed its support to open spectrum policy [2]. For instance, it favored the free use by everyone of so-called “white spaces” (bands of frequencies left unused by broadcasters) [3] and called on the swift roll-out of small network devices and antennas [4] that can be used by citizens and businesses to build shared mesh networks [5] and create the next generation of WiFi-like networks. The Parliament stressed that all these promising wireless technologies at the service of citizens can expand mobile broadband coverage in rural areas, thus bridging the digital divide. [6] However, as of today, Member States are pushing hard to strike down the Parliament's most innovative open spectrum amendments to the RSPP. A working document [7] shows that national governments - who are currently negotiating with the Parliament - want to get rid of the important references to these groundbreaking technologies (see table below). As the United States moves closer and closer from establishing a comprehensive legal and technical framework for using white spaces [8], the EU risks lagging behind because of our governments' conservatism under the pressure of telecom operators lobbies. "The open spectrum policy adopted by the European Parliament can play a key role in fostering access to a decentralized and citizen-oriented Internet architecture. By their attempt to block increased competition and innovation in wireless communications, national governments are serving dominant telecoms operators's attempts to control the flow of communications. We must not tolerate that governments undermine EU competitiveness and prevent underserved populations from participating in online communications. The Parliament must resist the pressure and defend an open wireless Internet", says Félix Tréguer, policy and legal analyst for La Quadrature du Net. Article 4.2.2 //EU Parliament:// Member States shall foster, in cooperation with the Commission, the collective use of spectrum as well as shared and unlicensed use of spectrum. They shall also foster current and new technologies such as geolocation databases and cognitive radio to develop for example in white spaces following a proper impact assessment. That impact assessment shall be issued within twelve months of the entry into force of this Decision . //EU Council:// Member States shall foster, in cooperation with the Commission and where appropriate, the collective use of spectrum as well as shared use of spectrum. Article 4.3.a //EU Parliament:// Member States shall intensify R&D on new technologies such as cognitive technologies as their development could represent an added-value in the future in terms of efficiency of spectrum use. //EU Council:// Erased Article 6.4.a //EU Parliament:// The Commission shall, in cooperation with Member States, assess the feasibility of extending the allocations of unlicensed spectrum for wireless access systems including radio local area networks established by Decision 2005/513/EC1 to the entire 5GHz band. //EU Council:// Erased Article 6.6.a //EU Parliament:// Member States, in cooperation with the Commission, shall examine the possibility of spreading the availability and use of picocells and femtocells. They shall take full account of the potential of those cellular base stations and of shared and unlicensed use of spectrum to provide the basis for wireless mesh networks, which can play a key role in bridging the digital divide. //EU Council:// Erased. * References * 1. http://www.europarl.europa.eu/oeil/file.jsp?id=5872922 2. http://www.laquadrature.net/en/eu-parliament-adopts-open-wireless-communica… 3. Dear friends, For the very first time, I will be able to visit Bejing in China during mid-November, attending a conference I have been asked to be discrete about for the moment. However, I would be interested in further opportunities to explain peer production and commons-related issues for Chinese audiences, Thanks for eventually thinking about this, I have nearly no contacts in that country, Michel -- P2P Foundation: http://p2pfoundation.net - http://blog.p2pfoundation.net Connect: http://p2pfoundation.ning.com; Discuss: http://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation Updates: http://del.icio.us/mbauwens; http://friendfeed.com/mbauwens; http://twitter.com/mbauwens; http://www.facebook.com/mbauwens
