The process of reorganization of class power, which started in the 1970s, has stabilised after the 2007-2008 crisis on the basis of austerity policies, the dismantling of workers’ rights and the welfare state , the contraction of democratic space, and punitive restrictions on the right to protest. We know the 1815 restoration was a reaction to the revolutionary conquests of 1789; can we say something analogous about this new restoration? Does this latter amount merely to a response to the attack launched by the subaltern classes in the ’60 -’70? Can we define neoliberalism, as David Harvey suggests, as the ‘restoration of class power?’. What deserves further exploration is the extent to which neoliberal restoration has acquired the offensive and constitutive dynamic traditionally linked to the concept of ‘revolution’. The interrelation between restoration and revolution emerges, in part, from the composition, nature and unfolding of the struggles that characterize our times: urban movements claim ing a ‘right to the city’, border conflicts, migrant struggles, the constellation of Arab ‘springs’, independent and conflictual trade unionism, experiments in workers’ self-management, feminist, queer and decolonial movements, rural, indigenous and environmental struggles . Can these new struggles contrast the neoliberal manipulation of those democratic forms that emerged from the post-war compromise between labour and capital, and between direct and representative democracy? Can new subjectivities, new rights from below, new institutions offer any foothold for detaching the idea of ‘revolution’ from its absorption by the mechanism of ‘restoration’? Within this complex and stratified framework, it is crucial to take-up the traditions of Marxist theory – from the in-depth analysis of Bonapartism by Marx and Engels to Workerism, passing through Gramsci and the reflections on the appropriation and subordination of anti-colonial movements – that have distinguished themselves by their capacity to interrogate the deep connection between revolution and restoration in the history of the capitalist social totality. ** *Separate calls go out for the following streams (click on titles for full CFPs):* <https://hmrome2015.wordpress.com/marxism-and-philosophy-along-the-frontiers…> Marxism and Philosophy: T <https://hmrome2015.wordpress.com/marxism-and-philosophy-along-the-frontiers…>he Italian Debate and its International Effects <https://hmrome2015.wordpress.com/marxism-and-philosophy-along-the-frontiers…> <https://hmrome2015.wordpress.com/marxism-and-philosophy-along-the-frontiers…>New World Disorder: Crisis, Conflicts and Transformations of Class Struggles <https://hmrome2015.wordpress.com/new-world-disorder/> Powers, Organizational forms, New Institutions <https://hmrome2015.wordpress.com/powers-organizational-forms-new-institutio…> <https://hmrome2015.wordpress.com/right-to-the-city/> <https://hmrome2015.wordpress.com/right-to-the-city/>The <https://hmrome2015.wordpress.com/right-to-the-city/>Right to the City <https://hmrome2015.wordpress.com/right-to-the-city/> ** *We welcome abstract proposals on these themes or any others, in all disciplines, from all continents and from all perspectives within Marxism.* ** *Please send your 200 words abstracts to: hmrome2015(a)gmail.com <hmrome2015(a)gmail.com>* ** *IMPORTANT: if you apply to any of the 4 strands listed above, add the title of the strand in your email subject.* Published in http://www.historicalmaterialism.org/news/distributed/historical-materialis… __._,_.___ ------------------------------ Posted by: Historical Materialism News <news(a)historicalmaterialism.org> ------------------------------ Reply via web post <https://groups.yahoo.com/neo/groups/historicalmaterialism/conversations/mes…> • Reply to sender <[email protected]?subject=Re%3A%20%E2%80%8Bhistorical%20materialism%20rome%20conference%202015-%20call%20for%20papers> • Reply to group <[email protected]?subject=Re%3A%20%E2%80%8Bhistorical%20materialism%20rome%20conference%202015-%20call%20for%20papers> • Start a New Topic <https://groups.yahoo.com/neo/groups/historicalmaterialism/conversations/new…> • Messages in this topic <https://groups.yahoo.com/neo/groups/historicalmaterialism/conversations/top…> (1) Visit Your Group <https://groups.yahoo.com/neo/groups/historicalmaterialism/info;_ylc=X3oDMTJ…> - New Members <https://groups.yahoo.com/neo/groups/historicalmaterialism/members/all;_ylc=…> 1 [image: Yahoo! Fwd: [opennetcoalition] In France, La Quadrature du Net Brings Legal Challenge Against Mass Surveillance
by Michel Bauwens 20 Feb '15

---------- Forwarded message ---------- From: La Quadrature du Net <contact(a)laquadrature.net> Date: Thu, Feb 19, 2015 at 11:35 PM Subject: [opennetcoalition] In France, La Quadrature du Net Brings Legal Challenge Against Mass Surveillance To: opennetcoalition(a)laquadrature.net Themes: CYBERCRIME, FREE SPEECH, NET FILTERING, TERRORISM, PRIVACY, PERSONAL DATA, SURVEILLANCE, MANUEL VALLS, AXELLE LEMAIRE, BERNARD CAZENEUVE, PRESS RELEASE La Quadrature du Net – For immediate release Permanent link: http://www.laquadrature.net/en/in-france-la-quadrature-du-net-brings-legal-… In France, La Quadrature du Net Brings Legal Challenge Against Mass Surveillance *** Paris, 19 February 2015 — Together with FFDN[1], a federation of community-driven non-profit ISPs, La Quadrature du Net is bringing a legal action before the French Council of State[2] against a decree on administrative access to online communications metadata. Through this decree, it is a whole pillar of the legal basis for Internet surveillance that is being challenged. This appeal, which builds on the European Union Court of Justice's recent decision on data retention, comes as the French government is instrumentalizing last month's tragic events to further its securitarian agenda, with an upcoming bill on intelligence services. *** In December 2013, the French Parliament voted the 2014-2019 Military Planning Act[3] (Loi de programmation militaire, or LPM), which included provisions on the extra-judiciary surveillance of the Internet: it not only increased the number of police and intelligence services with access to connection data, but the very scope of the data has also been widened (the law refers to the “information and documents”, “as well” as metadata both ISPs and hosting service providers may have). Furthermore, this new legal regime comes with no preliminary control by the CNCIS[4], the independant administrative authority in charge of supervision of administrative interceptions of communications, an administration which remains largely underfunded. Finally, this law makes it possible to engage in realtime surveillance of communications, “by soliciting the network” of operators, which in this case requires preliminary control by the CNCIS, but still leaves wide open the threat of direct and massive data interception. At the time, in the midst of a global debate surrounding Edward Snowden's revelations and as the French government was stubbornly refusing to be transparent on its own surveillance practices, these new provisions – which, according to their promoters, aim to validate existing “alegal” practices (that is to say, illegal practices) – sparked a strong opposition from civil society. But despite outcries, French Members of Parliament nonetheless refused[5] to appeal to the Constitutional Council to check the conformity of these measures with the Constitution. On 24 December 2014, the government quietly passed[6] the decree[7] implementing these measures. The publication of this decree is now the occasion for La Quadrature du Net, together with the FFDN ISPs, to challenge the entire legal construct of Internet surveillance, which developped over more than a decade. Through this legal challenge, it is indeed the very principle of a generalised surveillance of the population that is targeted. The applicable law is based on a wide-ranging data retention regime, whereby access providers and hosting platforms based on the French territory are forced to keep all their users' metadata for one year. Data retention was extended to the entire European Union by a 2006 directive[8] adopted following the emotion created by the Madrid and London attacks. Some national transposing laws had been declared contrary to the constitution in several Member States, including Germany where such a system is not currently enforced. Then, on 8 April 2014, the European Court of Justice (ECJ) issued a historical decision invalidating the entire 2006 directive. In its Digital Rights Ireland[9] ruling, the Court clearly explained that such data retention measures are contrary to fundamental rights. According to the ECJ: “Directive 2006/24 affects, in a comprehensive manner, all persons using electronic communications services, but without the persons whose data are retained being, even indirectly, in a situation which is liable to give rise to criminal prosecutions. It therefore applies even to persons for whom there is no evidence capable of suggesting that their conduct might have a link, even an indirect or remote one, with serious crime. Furthermore, it does not provide for any exception, with the result that it applies even to persons whose communications are subject, according to rules of national law, to the obligation of professional secrecy.” (§ 58, 2014-04-08 Judgment of the Court[10]) In this decision, it is the principle of massive data retention obligations that is challenged, in favour of a targeted surveillance of individuals for which there already exists a legitimate reason to restrict the right to privacy. Everywhere in Europe, the ECJ judgment questions the laws surrounding current Internet surveillance practices, in the context of the debate created by E. Snowden's revelations. In Austria[11], in Romania[12], in Slovakia[13] and in Slovenia[14], constitutional courts have since suspended or canceled national laws on data retention. In Sweden[15], in the Netherlands[16], and in the UK[17], important debates are ongoing. As part of procedures distinct from the ECJ's judgment, the UK's GCHQ was also recently convicted[18] for not being transparent regarding its data exchange practices with the NSA. Lastly, the GCHQ's programs are also the subject of a legal challenge before the European Court of Human Rights (ECHR) issued by a coalition of NGO, and to which La Quadrature du Net is taking part[19]. In France, up until now, the government has always refused to draw the lessons of the Snowden revelations or of the ECJ's judgment. On the contrary, these past months have seen the adoption of new exceptional measures, not only with the Military Planning Act but also the 2014 law against terrorism[20]. While the odious crimes in the Middle-East and in Africa and the deadly and tragic Paris attacks are currently being shamefully used to further authoritarian tendencies[21], with calls for once again extending surveillance and criminalising the encryption of communications, it is high time for France to also have this debate, both in the public space and before its jurisdictions. Police and courts must of course be able to do their job, but in a proportionate way and within the boundaries of the rule of law. That is the aim of this joint appeal before the Council of State. This is also the first legal challenge carried directly by La Quadrature du Net, whose 2013 by-laws[22] have made it possible to take legal action to defend citizens' fundamental rights in the digital sphere. Eventually, this legal challenge will make it possible not only to formally refer the issue to the Constitutional Council, since the LPM never underwent a constitutionality check, but also to confront existing French Law with the ECJ and the ECHR's case laws. * References * 1. http://www.ffdn.org/ 2. https://en.wikipedia.org/wiki/Conseil_d%27Etat_%28France%29 3. https://www.laquadrature.net/en/final-adoption-of-generalised-surveillance-… 4. https://fr.wikipedia.org/wiki/Commission_nationale_de_contr%C3%B4le_des_int… 5. https://www.laquadrature.net/en/final-adoption-of-generalised-surveillance-… 6. http://www.nextinpact.com/news/91534-le-decret-l-article-20-lpm-publie-on-f… 7. http://www.legifrance.gouv.fr/affichTexte.do?cidTexte=JORFTEXT000029958091&… 8. https://en.wikipedia.org/wiki/Data_Retention_Directive 9. https://www.laquadrature.net/en/data-retention-eu-court-of-justice-denounce… 10. http://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:62012CJ0293&r… 11. http://www.pcworld.com/article/2401520/austrian-court-axes-data-retention-l… 12. https://www.digitalrights.ie/romanian-constitutional-court-holds-data-reten… 13. https://edri.org/slovak-constitutional-court-suspends-data-retention-legisl… 14. https://www.ip-rs.si/index.php?id=272&tx_ttnews%5Btt_news%5D=1256 15. http://www.pcworld.com/article/2682732/swedish-isp-urges-european-commissio…. https://blog.cyberwar.nl/2015/02/dutch-dpa-issues-advice-on-revision-of-tel… 17. https://www.dontspyonus.org.uk/problem 18. http://www.theguardian.com/uk-news/2015/feb/06/gchq-mass-internet-surveilla… 19. https://www.laquadrature.net/en/la-quadrature-joins-the-legal-struggle-agai… 20. http://www.laquadrature.net/en/france-adopts-anti-terror-law-eroding-civil-… 21. http://www.laquadrature.net/en/instrumentalizing-fear-to-control-encrypted-… 22. https://www.laquadrature.net/files/Statuts%20LQDN.pdf ** About La Quadrature du Net ** La Quadrature du Net is an advocacy group that defends the rights and freedoms of citizens on the Internet. FLOSS4P2P: distributed FLOSS for communities (London, March)
by Chris P2Pvalue 20 Feb '15

20 Feb '15

*FLOSS4P2P: Call for Participation* A 2-day London workshop in March, gathering *FLOSS projects* that are building software for *peer production and organization*, with a focus on *distributed* platforms. *Scholarships* to attend are offered to grassroots communities. ** Context ** We know that the Internet was originally decentralized, with protocols and services built by hackers. However, with the arrival of the celebrated Web 2.0, centralization and corporations proprietary platforms seem to have taken over. Moreover, this centralized structure is used by governments to increase surveillance (following Snowden’s revelations), to blackout internet whenever it is needed (e.g. Egypt, Syria, or San Francisco’s BART) or to choke annoying activist organizations (such as Wikileaks). On the other hand, in the last few years we have seen the emergence of Internet-enabled collaborative communities building shared libre/open resources. Commons-based Peer to Peer Production (CBPP) is rapidly growing: not just for software and encyclopedias, but also for information (OpenStreetMap, Wikihow), hardware (FabLabs, Open Source Ecology), accommodation (Couchsurfing) and currency (Bitcoin, Altcoins). In the last few years, it has become clear to many that it is not enough to develop free/libre/open source (FLOSS) alternatives, but we also need to re-decentralize the Internet. Many initiatives are being undertaken under this premise (e.g. Ethereum, Diaspora, OwnCloud, MediaGoblin, Sandstorm). These new software tools may also be useful to boost CBPP communities further. In this workshop, we will gather those working around the decentralized FLOSS that could help CBPP/P2P communities. Hackers, academics, activists and interested stakeholders are welcome. **When** March 16-17th 2015 **Where** Fab Lab London http://fablablondon.org **Call for Proposals** We welcome proposals for: - Lightning talks (2m-5m): summarise your idea & receive feedback - Show & Tell presentations (20m): explain your project/tech/research - Tutorials on software tools (1h) Please email: lu.yang(a)surrey.ac.uk with your idea/proposals. The workshop will have both presentations and unconference-style participatory dynamics for finding points of collaboration and extraction of conclusions. ** Topics ** - Focus on FLOSS software with some of the following features: - Social: communication - e.g. social-networking, microblogging, reworked email - Social: collaboration - e.g. wikis, pads, wave, shared file hosting, multimedia repositories - Alternative to proprietary choices - Federated / Distributed / Interoperable - Open Standards - Secure / Encrypted - Encouraging Peer Production communities - Encouraging the construction/maintenance of Commons - Potential cases for discussion: - Diaspora (federated social network) - Wave (federated real-time collaboration) - Lorea (federated social network) - DarkWallet (distributed wallet & social network) - Ethereum (P2P infrastructure) - MaidSafe (P2P infrastructure) - Sandstorm.io (facilitates federated sw) - Mailpile (encripted email) - MediaGoblin (federated multimedia repository) - OwnCloud (file hosting) - … (your case) **Scholarships** There are a few scholarships for potential participants who wish to attend the event. The scholarship will cover participant’s travel and subsistence cost, up to €400. If you are interested in applying for the scholarship, please email: lu.yang(a)surrey.ac.uk before 28 February 2015, with a paragraph stating why you think your FLOSS is relevant, plus a short bio. Priority will be given to those with low resources, innovative FLOSS within the topics of the call, and being a grassroot community. ** More ** More info will be posted online in: http://p2pvalue.eu/2nd-floss4p2p-workshop Email queries to: lu.yang(a)surrey.ac.uk -- *Chris Pinchen * P2Pvalue <http://p2pvalue.eu/>

Fwd: [NetworkedLabour] Fwd: ZNet Commentary: Marina Sitrin: Bachilleratos Populares

Marina Sitrin: Bachilleratos PopularesZ Communications Daily Commentary We arrived late to the graduation. The entire block was full and there wasn’t a free seat in sight. Hundreds of people filled the street. Some people came dressed from work, and others, who had loved ones graduating, were dressed in their best clothes, cameras ready. I had no idea it would be such an elegant event. Incongruously it was held in the street that the neighbors had shut down, with chairs lent from the recuperated factory hosting the event, neighbor’s homes, a retirement home across the street and wood benches constructed just for the event. The stage was a makeshift construction with a hand-held microphone from the 1980s. But the people, the people attending were so elegant. The women graduating looked like they were going to their proms or quince celebrations in elaborate dresses, hair and faces made up and high heeled shoes – although many were decades older than fifteen or prom age. The spirit, joy, and pride on their faces and those of their families and neighbors was palpable. It was contagious. The pride was for graduating high school: something many people in poor and low working-class neighborhoods in Argentina do not get to do. For me, the joy of course was sharing in their pride at graduating, but also in recognizing how ‘regular’ this sort of thing had become for the community. The graduation took place in the street in front of the recuperated print shop Chilavert where the students had completed their three years of study: a street that the workers and families had shut down because they needed to. It was all so normal – normal in the revolutionary sense that Che Guevara spoke of normal – remarking that when the extraordinary becomes everyday you know it is a revolutionary time. The above described celebration took place in 2009, marking the first graduation of a Bachillerato Popular in Chilavert, in Buenos Aires, Argentina. I was again in Chilavert, speaking with popular educators from the Bachillerato five years later. The evolution since that first graduating class is remarkable, both within Chilavert and throughout Argentina. Already impressive in 2009, after only three years with more than 40 popular education centers and over 5000 students, five years later, that number has more than doubled with over 100 bachilleratos and many thousands of students. When one thinks of alternative high school programs certain images often come to mind, such as a wide diversity of participants based in age and experience. And when one thinks of popular education, one imagines learning and teaching based in local knowledge bases of the participants. The bachilleratos reflect these elements, and so much more. Ages of participants range from teens who were kicked out of high school often for alleged behavioral issues, to parents and grandparents, and all ages in between, including in one bachillerato on the outskirts of Buenos Aires where two of the students, in their later 70s, are the parents of one of the workers in the recuperated factory that houses that particular alternative high school diploma program. Most students come from poor, working poor and unemployed families, and most of the bachilleratos are located in these neighborhoods, ranging from those on the periphery of cities, in neighborhoods that resemble shanty towns, to ones such as Las Tunes, 40 kilometers outside Buenos Aires, which is self organized. Las Tunes is run by the community, using assemblies and is located on what was once a trash dump. The community has collectively built homes for the families in the town and many collective spaces, including a school and a bachillerato. As for popular education, this is where the bachilleratos are most innovative, creating new ways of not only teaching and learning, but relating to the community. Ninety-nine percent of the students in each bachillerato come from that community, thus there is a real dedication by the neighbors and people in the area for the success of the students and project. Many neighbors support the process in various ways from attending public events the students organize to bringing food and helping to build and later clean the spaces for education. Classes are organized with face-to-face meetings, influenced by or using direct democracy, striving for full participation and the breaking down of hierarchy. The size of the groups range from ten to thirty people, with each group choosing what they will study, how, where, and then what they will do at the end of the study process. To say the students choose what course of study they will undertake is to say a great deal. When do students anywhere get to enter a classroom setting and decide the themes around which they will learn? In the bachilleratos they do. For example, in the bachillerato in Chilavert the education is organized around the ideas of coopertivism and its interpretation via recuperation – so more along the lines of self organization and horizontalism than traditional concepts of cooperatives. Not only do the students have an underlying course of study of self organization in Chilavert, but since its inception in 2007, the bachilleratos now include classes taught by a few of the workers. Not only does the bachillerato in Chilavert decide how and what to study collectively and democratically they also collectively deal with whatever tensions or problems arise in the classroom. This is based in the agreement that no student will be expelled from the bachillerato. It is a bit tricky since there are agreements that have to be met so that a person can graduate. So, what happens then if a person does not comply with an agreement? Rather than punishing that student, they organize an assembly of all students and teachers and also include a few of the workers from Chilavert. They discuss the issue collectively and decide what can be done so as to remedy the problem. Generally this has only been reflected in small issues such as missing too many classes or a lack of participation. There is a mechanism however for a more serious transgression, which did occur once, and in that case the student was asked to leave for a short period of time, reflect on what happened and then write and present something based on their reflections to the entire group – students, teachers and workers. It was successful. It is very much reminiscent of the circle justice forms used by some First Nations in Canada Each graduating class of a bachillerato has to create a collective project. These are quite wide ranging depending on the location and thematic of the course of the education. In Chilavert, each year, the students have created various publications and over time also community radio programs. The first graduating class created notebooks that they printed together on the machines of the workplace, having learned the basics of printing from the workers. The notebooks are for sale to the community to offset the cost of printing and then free for the next entering bachillerato class. Inside the notebooks, on the margins of every page are quotations from the students reflecting their thoughts and feelings regarding education. They see this as sharing and passing down some of their knowledge about education. For example, a few read, “Education is not a business – Education makes us free.” “We dedicate ourselves every day to fight for an education that includes everyone.” “Opening schools and fighting for popular and public education.” Since the first graduating class the projects in Chilavert have become increasingly sophisticated, in content and in form, including not only notebooks, but calendars, note cards and pamphlets. And the students who graduate have increasingly continued to help the incoming classes, with tow graduates even becoming teachers and now participating in the Bachillerato Popular in IMPA, another recuperated workplace and community center in Buenos Aires. This is just one example of the now over 100 Bachilleratos Populares in Argentina. There are, as with all of the movements in Argentina, differences and tensions in how to self organize, and in particular in relationship to the state. The government recognizes the bachilleratos and the degrees that the students receive, though whether a bachillerato receives subsidies for the teachers is another question and one based in how that particular high school diploma course is organized. For example, the state demands that there is a formal hierarchy of roles with the teachers and a specific form of division of money – something that I have heard is not evenly complied with in reality but is on paper. There are other similar such requirements that have resulted in some bachilleratos not taking money from the state while others use it as a way to help a movement or community survive, dividing the money the teachers receive more evenly among the teachers and in the community. It is yet another way the government has managed to appear as if it is playing a totally supportive role, yet underneath there are divisions in the movements emerging based on this support. Participants in the movement reflect that the self organized nature of the schools is directly connected to the horizontal and assembly based movements that came out of the popular rebellion of December 19 and 20, 2001. Recuperated workplaces, neighborhood assemblies, unemployed movements, occupations of land and self organized art and media groups emerged in massive numbers throughout the country after 2001. The Bachilleratos Populares are a sort of hijo (child) of this form of organization and continue the in the same form and spirit as those out of the rebellion of the 19/20th.
