The Co-Intelligence Symbol . *What this message is about:* *Climate change is so big and pervasive we can hardly see it. There's almost nothing in our collective lives that is bigger in its implications. The changes it demands of us are the most profound we have ever faced and they are growing increasingly urgent. Among our most radical challenges is building the capacity for whole societies to be smarter and wiser collectively than we are individually...* Climate Change and Collective Intelligence<https://go.madmimi.com/redirects/1384547518-41742eeef76849a47ad95a9d0cd7e12…> [image: 220px-Yin_and_Yang.svg] Co-evolution of Danger and Opportunity Climate change is perhaps the largest and most hard to grasp crises we've ever faced. It is so much more than "global warming" and "rising seas". Its ramifications are so many, so diverse, and so planetary. Perhaps the biggest challenge before this one was the very real possibility of global thermonuclear war during the Cold War. Numerous times we were mere minutes away from global holocaust. We've made it through those global rapids... so far. There are many other potential crises that could be terminal for humanity - like virulent genetically engineered viruses or self-replicating nanobots consuming the environment. But those are possibilities, not certainties. In contrast, climate change is here and growing. Climate change is today and the day after tomorrow. We can probably still ameliorate it, but not for much longer. And, unfortunately, we can no longer stop it. *That makes it a fascinating case for exploring collective intelligence - our ability to collectively perceive, reflect, act, and review our actions, done together as an ongoing process of evolving harmonization with the world around us.* Remarkably, humanity as a whole isn't really grasping that this climate transformation is happening, despite our collective scientific and technological means for observing it. We aren't SEEING it, collectively, really. Or perhaps I should say that we are collectively seeing something but can't quite decide what it is and if it is real. (Remember, I'm speaking here of "us" as the whole of humanity. Of course many people and groups DO see it and urgently engage with it. But as a collective entity, we're not even mostly on board with the true reality of it.) Journalism, a key dynamic in collective perception at the whole-society level, is definitely failing to play its proper role in public awareness of climate change. More often than not, it provides entertaining blinders. And of course it is not only our collective perception that is lacking. So, too, is our capacity for collective reflection - including public conversations, news analysis, and deliberations in legislatures, courtrooms and board rooms. Here and there we find truly sustained attention and creative strategizing. This, of course, leads to little collective decision-making and implementation and no concerted review of how any of our efforts at dealing with this crisis are actually working.... at a whole-society, whole-humanity level. Again, there are exceptions. But overall there is a concerted effort to avoid straying too far from business-as-usual. But that's the simplicity of collective intelligence - perception, reflection, action, and review, done together as an ongoing cycle - institutionalized in our culture, our governance, our economics, our education - all aspects of our public life. Our innate cognitive limitations - e.g., as individuals we can't SEE climate change - combined with money-distorted politics and PR manipulations make it exceedingly difficult for us to exercise much collective intelligence about climate change. We don't currently have the capacity to collectively recognize that our economic and political systems are systematically killing us - "us" not being just you and me, but civilization itself - relentlessly, even as more and more money flows through those systems leaving behind the fantasy of prosperity. Once seen, it becomes clear that not only do we need to handle climate change, we need to handle the cultural and systemic arrangements that have impeded our ability to handle climate change (as well as to handle all other issues we face). The implications are truly revolutionary - or, if you prefer, radically transformational. *What do we need to do to radically transform our capacity to collectively realize what is happening in and around us, to collectively reflect on what should be done about it, to collectively act on the best solutions and initiatives we can come up with together, and to collectively note and reflect on the results? What changes to politics, economics, governance, education, journalism, technology, culture, community, and the shape of our lives and our world could enable us to be more intelligent and wise together?* The answers are never-ending and urgently important. The two pieces excerpted below tackle both the difficulty of comprehending our situation and, once we overcome that difficulty, some of the radical implications of what's needed. There is much more to be said about that, but these articles along with my commentary above provide a thought-provoking starting place. I recommend the long forms of both articles, available at the links provided. But the excerpts will give you a good taste of them quickly. Coheartedly, Tom = = = = = = = = = = = = Excerpt from How science is telling us all to revolt<https://go.madmimi.com/redirects/1384547518-f870847667a84183c39bf09f2bdec63…> Is our relentless quest for economic growth killing the planet? Climate scientists have seen the data – and they are coming to some incendiary conclusions. By Naomi Klein Brad Werner... geophysicist from the University of California, San Diego [gave a complex systems theory presentation at the Fall Meeting of the American Geophysical Union in December 2012 entitled] “Is Earth F--ked? Dynamical Futility of Global Environmental Management and Possibilities for Sustainability via Direct Action Activism”. [In it, he concluded that] global capitalism has made the depletion of resources so rapid, convenient and barrier-free that “earth-human systems” are becoming dangerously unstable in response. When pressed by a journalist for a clear answer on the “are we f--ked” question, Werner set the jargon aside and replied, “More or less.”.... [Werner] is saying that his research shows that our entire economic paradigm is a threat to ecological stability. And indeed that challenging this economic paradigm – through mass-movement counter-pressure – is humanity’s best shot at avoiding catastrophe. That’s heavy stuff. But he’s not alone. Werner is part of a small but increasingly influential group of scientists whose research into the destabilisation of natural systems – particularly the climate system – is leading them to similarly transformative, even revolutionary, conclusions.... [D]itching of [the present economic order] in favour of something new (and perhaps, with lots of work, better) is no longer a matter of mere ideological preference but rather one of species-wide existential necessity.... Kevin Anderson, the deputy director of the Tyndall Centre for Climate Change Research, .... points out that the chances of staying within anything like safe temperature levels are diminishing fast. With his colleague Alice Bows, a climate mitigation expert at the Tyndall Centre, Anderson points out that we have lost so much time to political stalling and weak climate policies – all while global consumption (and emissions) ballooned – that we are now facing cuts so drastic that they challenge the fundamental logic of prioritising GDP growth above all else.... To have even a 50/50 chance of hitting the [agreed upon international] 2 degrees [Celsius] target (which...already involves facing an array of hugely damaging climate impacts), the industrialised countries need to start cutting their greenhouse-gas emissions by something like 10 per cent a year – and they need to start right now.... Anderson and Bows [point] out that this target cannot be met with the array of modest carbon pricing or green-tech solutions usually advocated by big green groups. These measures will certainly help, to be sure, but they are simply not enough: a 10 percent drop in emissions, year after year, is virtually unprecedented since we started powering our economies with coal. In fact, cuts above 1 percent per year “have historically been associated only with economic recession or upheaval”, as the economist Nicholas Stern put it in his 2006 report for the British government.... So what Anderson and Bows are really saying is that there is still time to avoid catastrophic warming, but not within the rules of capitalism as they are currently constructed. Which may be the best argument we have ever had for changing those rules. In a 2012 essay that appeared in the influential scientific journal Nature Climate Change, Anderson and Bows laid down something of a gauntlet, accusing many of their fellow scientists of failing to come clean about the kind of changes that climate change demands of humanity. On this it is worth quoting the pair at length: ". . . in developing emission scenarios scientists repeatedly and severely underplay the implications of their analyses. When it comes to avoiding a 2 degree [Celsius] rise, 'impossible' is translated into 'difficult but doable', whereas 'urgent and radical' emerge as 'challenging' – all to appease the god of economics (or, more precisely, finance). For example, to avoid exceeding the maximum rate of emission reduction dictated by economists, 'impossibly' early peaks in emissions are assumed, together with naive notions about 'big' engineering and the deployment rates of low-carbon infrastructure. More disturbingly, as emissions budgets dwindle, so geoengineering is increasingly proposed to ensure that the diktat of economists remains unquestioned.".... By August 2013, Anderson was willing to be even more blunt, writing that the boat had sailed on gradual change.... "Today, after two decades of bluff and lies, the remaining 2°C budget demands revolutionary change to the political and economic hegemony”.... = = = = = = Excerpts from Bigger Than That: (The Difficulty of) Looking at Climate Change<https://go.madmimi.com/redirects/1384547518-a6caadb389fbde9f00ae4e4dab73988…> by Rebecca Solnit We’re not very good at looking at the biggest things. They may be bigger than we can see, or move more slowly than we have the patience to watch for or remember or piece together, or they may cause impacts that are themselves complex and dispersed and stretch into the future. Scandals are easier. They are on a distinctly human scale, the scale of lust, greed, and violence. We like those, we understand them, we get mired in them, and mostly they mean little or nothing in the long run (or often even in the short run).... Some things are so big you don’t see them, or you don’t want to think about them, or you almost can’t think about them. Climate change is one of those things. It’s impossible to see the whole, because it’s everything. It’s not just a seven-story-tall black wave about to engulf your town, it’s a complete system thrashing out of control, so that it threatens to become too hot, too cold, too dry, too wet, too wild, too destructive, too erratic for many plants and animals that depend on reliable annual cycles. It affects the entire surface of the Earth and every living thing, from the highest peaks to the depths of the oceans, from one pole to the other, from the tropics to the tundra, likely for millennia -- and... it’s already here. It’s not only bigger than everything else, it’s bigger than everything else put together. But it’s not a sudden event like a massacre or a flood or a fire, even though it includes floods, fires, heat waves, and wild weather. It’s an incremental shift over decades, over centuries. It’s the definition of the big picture itself, the far-too-big picture. Which is why we have so much news about everything else, or so it seems. To understand climate change, you need to translate figures into impacts, to think about places you’ll never see and times after you’re gone.... We like to think about morality and sex and the lives of people we’ve gotten to know in some fashion. We know how to do it. It’s on a distinctly human scale. It’s disturbing in a reassuring way. We fret about it and feel secure in doing so. Now, everything’s changed, and our imaginations need to keep pace with that change. What is human scale anyway? These days, after all, we split atoms and tinker with genes and can melt an ice sheet. We were designed to think about human-scale phenomena, and now that very phrase is almost as meaningless as old terms like “glacial,” which used to mean slow-moving and slow to change.... If there is to be an effort to respond to climate change, it will need to make epic differences in economics, in ecologies, in the largest and most powerful systems around us. Though the goals may be heroic, they will be achieved mostly through an endless accumulation of small gestures. Those gestures are in your hands, and everyone’s. Or they could be if we learned to see the true scale of things, including how big we can be together. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ site: http://www.co-intelligence.org<https://go.madmimi.com/redirects/1384547518-b6094532f9cc56950793190464a981d…>/ blog: http://tomatleeblog.com<https://go.madmimi.com/redirects/1384547518-11ecf481580037ea715aa3c385d6594…> Read Empowering Public Wisdom<https://go.madmimi.com/redirects/1384547518-567d47071675fa2c6a9710221d459e4…>, The Tao of Democracy<https://go.madmimi.com/redirects/1384547518-3ce46cca109625c446e20f7d4b198d4…>and Reflections on Evolutionary Activism<https://go.madmimi.com/redirects/1384547518-0991ec37885b7512af827dc51b13b53…> Please support our work. [Maurer School of Law], Micol Seigel [American Studies & History], and Beverly Stoeltje [Anthropology & Folkore and Ethnomusicology]* Present *"Community Justice Commons: Community Policing vs Co-Produced Conflict Resolution?"* Date: Friday, November 15th, 2013 Time: Noon-1:30pm Location: The Vincent and Elinor Ostrom Workshop in Political Theory and Policy Analysis, 513 N. Park Avenue Live Stream URL: http://www.indiana.edu/~video/stream/liveflash.html?filename=Colloquia Archive Stream URL: http://www.indiana.edu/~video/stream/launchflash.html?folder=video&filename…<http://www.indiana.edu/~video/stream/launchflash.html?folder=video&filename…> *Community Justice Commons: Community Policing vs Co-Produced Conflict Resolution*: Recent literature revisiting Lin Ostrom’s metropolitan police studies suggests that superficial recognition of their findings and inconsistent adoption of “community policing” programs sowed the seeds for ineffective and unsustainable efforts to encourage community-responsive and community co-produced public safety arrangements [Boettke et al 2012]. The authors largely attribute these programmatic failures to (1) “institutional incompatibilities” between the programs and their institutional contexts (in both police organizations and broader community culture) and (2) “perverse incentives” created by federal intervention into local policing operations, including a push for consolidated communications and strategic coordination of standard operations, as well as a number of “asset sharing” programs for the development of “police paramilitary units” (PPUs) [ibid]. Though the authors imply the benefits of engaged, community co-production of public safety (as a public good), the range of options that they consider vis-à-vis Ostrom Workshop scholarship is constrained to include only those institutional arrangements that are anchored-in, devised, and implemented by apparatuses of the state. But, why, in a study on community policing, would they embrace such constraints? The nature of public safety, as a public good, suggests that its production requires “a collective arrangement in which [community members] agree to reward those who provide public goods and/or punish those who fail to contribute,” which is typically embodied by different organizational scales of the state [3]. Still, the authors mention that there is both “[t]heoretical and experimental literature shows that individuals are capable of overcoming the collective action problem in the absence of formal government” [ibid]. *However, is it possible for public safety to be produced by community organizations and social-arrangements that operate outside of or in parallel with the organizations and legal systems of the state? Can it only play a supplementary role? * In Bloomington, we have a fine example of a non-state alternative dispute resolution organization: the Community Justice and Mediation Center, a community-based non-profit that provides mediation and restorative justice services and related educational outreach programs. Though focusing more on alcohol and drug related issues, the IU campus has an organization that provides alternative resolutions for drug and alcohol violations, counseling, and related programming assistance: OASIS. To what extent do these help to create a community justice commons…and how could they be enhanced or extended? *Further, can other Workshop tools – like the IAD framework and the Design Principles – help us to explore the community-oriented solutions, supplementing earlier concepts of “polycentricity” and “co-production?” * Though the design principles of sustainable common-pool resource governance apply most directly to social arrangements that mediate the relationship between persons and material goods, their emphasis on community-devised norms and rules may provide unique insights into community co-production of public safety. For example, Principle 2 emphasizes “congruence between…rules and local conditions,” suggesting that information about local conditions is paramount [Cox, Arnold, and Villamayor-Tomás 2010]. Further, Principle 3 encourages that “most individuals affected by the operational rules can participate in modifying the operational rules,” [ibid] which is supported by evidence that “[i]ndividuals not only have better knowledge of their own circumstances…but they are also more likely to perceive rules of their own design as fair and worth following (Ostrom 1990, Ostrom 2000)” [Boettke 2012: 10]. Principle 6 “states that systems with low-cost conflict resolution mechanisms are more likely to survive,” casting some doubt on the functional optimality of an inflated, federally incentivized police and court system [Cox, Arnold, and Villamayor-Tomás 2010]. And, Principle 7 maintains that sustainable community governance requires a sufficient degree of autonomy in the construction of local social arrangements, “stipulate[ing] that external government agencies do not challenge the right of local users to create their own institutions” [ibid]. The purpose of this panel is to invite critical reflection on the concept of “community justice” with reference to theoretical tools and empirical evidence derived from studies at the Ostrom Workshop. Our three panelists were invited for the diversity of their expertise: as practitioners, scholars, and IU/Bloomington community members with differing levels of involvement with community justice issues and different levels of experience with the Ostrom Workshop. *Edwin Greenebaum*<http://www.bloomingtoncommunityorchard.org/site/about/about-the-board/> For over 30 years as a law professor at Indiana University<http://info.law.indiana.edu/faculty-research/faculty-staff/profiles/faculty…>, Professor Greenebaum's teaching and writing focused on dispute resolution and on the professional development of individuals, the organizations in which they work, and how the two relate to one another. His courses included Civil Procedure, Alternative Dispute Resolution, Mediation, Roles and Relations in Legal Practice, and Understanding Clinical Experience. Since his retirement in 2000, Greenebaum has worked with the Community Justice and Mediation Center (CJAM) which provides community mediation and conflict resolution education for Bloomington and Monroe County His roles in CJAM include Board Member, Chair and Director of Programming, community mediation case manager, senior mediator, and trainer. *Micol Seigel* <http://www.indiana.edu/~amst/faculty/seigel.shtml><http://info.publichealth.indiana.edu/faculty/current/farmer-james-r.shtml>is an Associate Professor in the <http://www.indiana.edu/~amst/faculty/seigel.shtml>Departments of American Studies <http://www.indiana.edu/~amst/faculty/seigel.shtml> and History. At times I have concentrated on representations of women in performance such as the rodeo, and at other times I have focused on women of the American West, especially the cowgirl. My interest shifted to Asante Queen Mothers in 1990, however, the female leaders of the Asante and the larger group of Akan peoples of Ghana. Concentrating on their role as performed in contemporary society has led me to the anthropology of law, particularly the law of the Asante people as practiced in what is called the "customary courts" of Ghana...Consistent with this interest in the dissemination of ideologies and rituals is my interest in forms of nationalism. Specifically, I define my interest as the intersection of nationalism and symbolic forms. Understanding the fundamentals of social movements that are recognized as cultural nationalism or national identities and the symbolic forms such as narrative, law, film, literature, song and ritual genres that are associated with them, is the goal of much of my work as well as that of a course I teach called, "Performing Nationalism." *There will NOT be a Commons Conversations Potluck this week.* All the Best, Ryan T. Fwd: [opennetcoalition] Failure of "Licenses for Europe" Underlines the Need for Reform of the EU Copyright Framework

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Wed, Nov 13, 2013 at 1:22 PM Subject: [opennetcoalition] Failure of "Licenses for Europe" Underlines the Need for Reform of the EU Copyright Framework To: opennetcoalition(a)laquadrature.net Themes: COPYRIGHT, LICENCES FOR EUROPE, MICHEL BARNIER, EU COMMISSION, JOINT PRESS RELEASE JOINT PRESS RELEASE – For immediate release Permanent link: https://www.laquadrature.net/en/failure-of-licenses-for-europe-underlines-t… Failure of "Licenses for Europe" Underlines the Need for Reform of the EU Copyright Framework *** Brussels, 13 November 2013 — Ahead of the last meeting of the “Licences for Europe” [1] initiative, five European citizen organisations – Centrum Cyfrowe [2], EDRI [3], Kennisland [4], Modern Poland Foundation [5], and La Quadrature du Net – release the following joint press release reaffirming the urgent need of an European Copyright reform. *** ** Failure of "Licenses for Europe" underlines the need for reform of the EU copyright framework ** Today, the Licenses for Europe experiment comes to an end. This initiative, launched almost a year ago was ostensibly an attempt to 'explore the potential and limits of innovative licensing and technological solutions in making EU copyright law and practice fit for the digital age'. At the end of this process we are compelled to conclude that 10 months of meetings have largely failed to identify any solutions which can be backed by all, or even the majority of, stakeholders involved. It is evident that there is very little consensus among stakeholders about the appropriate approach to making EU copyright law and practice fit for the digital age. It is unclear as to how licensing solutions can provide a significant improvement to a copyright system that has been widely recognised as being inefficient and out of date. As a result, and as many stakeholders have been arguing for years, it is long past time that the European Commission initiated a full review of the existing copyright framework to identify areas where legislative changes are needed. We call on the Commission to stop delaying this urgent step, to proceed now, and to waste no additional time in further discussion on whether or not legislative action is necessary. In real policy making terms this means that the copyright directive must be analysed by reopening the list of possible exceptions, and reviewing each individual exception to determine if and how they need to be adapted to the changed environment. As all of the exceptions are, by definition, compliant with the 3-step-test, they should be made mandatory, in order to avoid an unnecessary restriction on access to culture and freedom of communication. * 'User Generated Content' * Our organisations participated in Working Group 2 of the stakeholder dialogue on 'User-generated Content and Licensing for Small-scale Users of Protected Material'. From the start this working group has struggled to identify, let alone agree, a (set of) problem(s) that need to be addressed: Civil society groups and representatives of users have stressed the need to have clearly established rights for European citizens that allow them to create and share works that include protected works from third parties. The representatives of rights holders have insisted that this is not necessary. Instead they have advocated an approach where rights holders license their works to platform operators, which would in turn allow users of these platforms to share such works via these platforms. Given the focus of the Licenses for Europe process on 'innovative licensing and technological solutions' and the explicit refusal of the Commission to allow any discussion of other approaches the stakeholder dialogue proved itself to be incapable of even attempting to reconcile these different approaches. It has however clearly shown that the general approach of facilitating the agreement of licensing arrangements between rights holders and platform operators does not produce outcomes that address the needs of the public and other non-industry stakeholders such as institutions in the public sector. In the current technological environment, copyright affects ordinary citizens and many professionals, such as teachers and cultural heritage professionals, that are not represented by the two industries that Commission’s approach suggests are the only legitimate stakeholders. There are user rights at stake in this discussion that are extremely important in fields other than popular culture, in particular in education, but also for political expression and democratic participation. Looking back, it is difficult to view the proceedings of Working Group 2 as anything other than a fundamentally undemocratic attempt to subjugate the ability of citizens to express themselves through digital media to the outcome of licensing negotiations between rights holders and platform operators. Such a process does not create rights, it would simply authorise certain forms of expression on the terms of rights holders. * Looking forward * This means that the discussion needs to shift to the question of how we can best guarantee the right of European citizens to make transformative use of protected materials, in order to express themselves via digital media. Canada has recently introduced an exception for such uses into its copyright law. Member states such as the Netherlands are currently exploring the possibility of broadening an existing exception to achieve the same effect. >From our perspective, any attempt to 'make EU copyright fit for the digital age' should follow these examples and reform current copyright legislation. It is worth noting that these examples only address non-commercial uses by private individuals and as such do not unreasonably restrict the ability of rights holders to negotiate licenses for commercial uses that platforms make of the works in question. As stated above, such actions need to be integrated into a full review of the EU copyright directive that also looks at the issues that have been adressed in other working groups (such as Text and Data Mining) and issues that have been left outside of the scope of the Licenses for Europe process (such as use of protected materials for educational activities). - Centrum Cyfrowe - EDRI - Kennisland - Modern Poland Foundation - La Quadrature du Net * References * 1. https://www.laquadrature.net/en/the-eu-commissions-outrageous-attempt-to-av… 2. http://centrumcyfrowe.pl/ 3. http://www.edri.org/ 4. http://www.kennisland.nl/ 5. http://nowoczesnapolska.org.pl/ ** About la Quadrature du Net ** La Quadrature du Net is an advocacy group that defends the rights and freedoms of citizens on the Internet.
