Fwd: [fcforum] brussels, June 7: hearing - on the enforcement of intellectual property rights

---------- Forwarded message ---------- From: at <at(a)kein.org> Date: Thu, May 12, 2011 at 9:00 PM Subject: [fcforum] brussels, June 7: hearing - on the enforcement of intellectual property rights To: fcforum(a)list.fcforum.net Will anyone be in Brussels for this or consider attending? Public Hearing Directive 2004/48/EC on the enforcement of intellectual property rights: Challenges posed by the digital environment http://ec.europa.eu/internal_market/iprenforcement/docs/conference20110607/… A piece from Monica Horten's iptegrity.com ------------------- 3-minute speech limit at EU copyright hearing Written by Monica Horten May 10, 2011 at 11:38 PM The European Commission threatens to handbag* all speakers who go over 3-minutes at a public hearing on the IPR Enforcement directive (also known as IPRED). A key focus of the hearing will be Internet copyright enforcement and peer-to-peer file-sharing. What will the Commission's new, ex-IFPI, head of copyright have to say? Following the demise of its secret ‘stakeholder dialgoue', the European Commission has announced a public hearing on intellectual property enforcement in the digital environment. The hearing - on the enforcement of intellectual property rights: Challenges posed by the digital environment - is the final part of DG Markt's consultation exercise regarding the IPR Enforcement directive (IPRED). The Commission's objective is to obtain further feedback to its plans for revision of this directive. According to the Commission's Communication on the IPRED review, the main focus of the policy agenda is Internet enforcement, and the Internet will be the main discussion topic for the hearing. Challenges in this context, means how to stop peer-to-peer file-sharing, and how to get the ISPs to do the dirty work for the rights-holders, in enforcing copyright online. The head of intellectual property policy at the European Commission, Margot Fröhlinger, will be chairing the discussion. Potentially over two hours of time has been allocated for stakeholder comments. But anyone who wants to speak must register beforehand, and will only be allowed to speak 3 minutes. We should therefore ask whether the Commission is really willing to listen to anyone other than a few favoured lobbyists, and whether the public interest will be considered? It is likely that the three-minute limit will be enforced, and one does have to question whether the Commission will enable a balance of interests to be heard. In particular, I do wonder whether she will permit citizens groups to speak at all. In 2008, I attended a hearing at the beginning of the Telecoms Package with a similar 3-minute rule, and the gavel came down swiftly on head of the telecoms lobby group, ETNO, when he tried to speak for longer. It was ETNO who brought down Mrs Fröhlinger's recent ( and secret) Stakeholder Diablogue talks. Observers will be keenly interested to see Margot Fröhlinger's number two in copyright, Maria Martin Prat and any presentations by her will be closely watched. Ms Martin-Prat, formerly worked as Director of Legal Policy for IFPI, the music industry lobby group , and was recently appointed as head of the European Commission's Copyright Unit. She replaces Tilman Lueder who has apparently left the Commission. Ms Martin Prat's appointment to head the copyright unit is highly controversial and her ability to act impartially has been highlighted. As a member of the Commission services, she is a civil servant, and is duty bound to show no favoritism, however, her former connection with IFPI does raise question marks and will certainly test her integrity to the full. My first question is - which brand of handbag does she carry? ----- + info http://list.fcforum.net/wws/info/fcforum ------- -- P2P Foundation: http://p2pfoundation.net - http://blog.p2pfoundation.net Connect: http://p2pfoundation.ning.com; Discuss: http://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation Updates: http://del.icio.us/mbauwens; http://friendfeed.com/mbauwens; http://twitter.com/mbauwens; http://www.facebook.com/mbauwens

Fwd: [opennetcoalition] EU Parliament Adopts Open Wireless Communications Policy
by Michel Bauwens 11 May '11

11 May '11

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Wed, May 11, 2011 at 12:32 PM Subject: [opennetcoalition] EU Parliament Adopts Open Wireless Communications Policy To: opennetcoalition(a)laquadrature.net La Quadrature du Net - For immediate release Permanent link: http://www.laquadrature.net/en/eu-parliament-adopts-open-wireless-communica… EU Parliament Adopts Open Wireless Communications Policy *** Paris, May 11th, 2011 – Today, the European Parliament adopted a bill planning out EU spectrum policy for the years to come, including very important amendments in favor of an open access to airwaves. By supporting shared and unlicensed use of spectrum, the Parliament paves the way for the development of the next generations of free wireless Internet communications (“next generation WiFi”). This strong stance in favor of a communications policy promoting innovation and democracy now needs to be approved by EU Member States (via the EU Council) and the Commission. *** For years, policy-makers have given licenses that grant only a few operators access to the radio electric resource. Now, advances in radio technologies allow us to envision major evolutions in wireless communications, where access to the spectrum can be shared between all users, without risk of harmful interference. This is what the great success of WiFi networks demonstrate. And this is what can now be pushed further thanks to the first EU radio spectrum policy programme (RSPP) adopted today by the EU Parliament, which opens the door for an open spectrum policy [1]. Today, members of the Parliament adopted amendments encouraging unlicensed uses of spectrum, and in particular of so-called “white spaces” (bands of frequencies located between frequencies allocated to industries and left unused) [2]. Other amendments open the door to the use small antennas [3] that can be used by citizens and businesses in conjunction with land-line broadband networks to build wireless mesh networks [4]. These technologies can expand mobile broadband coverage in less populated or remote areas, thus bridging the digital divide, in particular when they are used in conjunction with shared and unlicensed uses of the airwaves [5]. "This vote suggests a growing understanding that the way we grant access to airwaves for wireless communications, and to whom, is of prime importance for both democracy and innovation. By turning parts of the airwaves into a shared resource once again, we can lower the cost of broadband roll-out, help bridge the digital divide and kick-start the new wave of innovation in mobile communications. This vote is a first step in this direction", explains Félix Tréguer, policy and legal analyst for La Quadrature du Net. “The EU Parliament cast a very encouraging vote in favor of free and open wireless communications, and successfully resisted the pressure of telecoms and broadcasting industries who want to remain in control of airwaves. We now need to make sure that the Member States and the Commission will actually and promptly follows the opinion of the Parliament towards an open spectrum policy,” concludes Jérémie Zimmermann, co-founder and spokesperson of the citizen organization. * Références * 1. See "The Spectrum Of Our Freedom". Address: http://www.laquadrature.net/en/the-spectrum-of-our-freedoms 2. See in particular the following amendment: Member States shall foster, in cooperation with the Commission, the collective use of spectrum as well as shared and unlicensed use of spectrum, and foster current and new technologies such as geolocation database and cognitive radio to develop for example in white spaces after proper impact assessment is made. Such impact assessment shall be released no later than twelve months after the adoption of this decision. The Parliament adopted the following paragraph: Member-States, in cooperation with the Commission, shall examine the possibility to spread the availability and use of picocells and femtocells. They shall take full account of the potential of these cellular basestations and of shared and unlicensed use of spectrum to provide the basis for wireless mesh networks, which can play a key role in bridging the digital divide. ** About la Quadrature du Net ** La Quadrature du Net is an advocacy group that promotes the rights and freedoms of citizens on the Internet. opening up sim cards and green 5g networks
by Michel Bauwens 10 May '11

10 May '11

http://billstarnaud.blogspot.com/2010/09/new-business-and-research-opportun… Hi Sepp, could you look into 2 important issues discussed here, i.e. 1) opening up sim cards and 2) 5G networks, i.e. 4G plus green ? see: 'Rudolf van der Berg has written a great report for the Dutch Ministry of Economic Affairs on how we can make SIM cards open and accessible to everyone which enable a whole new generation of wireless networks and applications. Freeing the SIM cards will allow users, R&E networks, community networks to deploy their own Internet wireless infrastructure that integrates Wifi, Whitespace, FTTH, mesh networks and traditional 3G/4G networks. This will also allow them to extend the 5G network with solar or wind powered WiFi or GSM nodes in specific areas – especially where there is no business case for the network operator e.g. environmental networks." -- P2P Foundation: http://p2pfoundation.net - http://blog.p2pfoundation.net Connect: http://p2pfoundation.ning.com; Discuss: http://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation Updates: http://del.icio.us/mbauwens; http://friendfeed.com/mbauwens; http://twitter.com/mbauwens; http://www.facebook.com/mbauwens

the rules of distributed leadership
by Michel Bauwens 10 May '11

10 May '11

Dear Curtis, I appreciate your summary below and would like to reprint it on the p2p blog ... would you like to expand and improve on it before? Michel Curtis Faith <curtis(a)worldhouse.org> May 09 01:39PM -0400 ^<?ui=2&view=bsp&ver=ohhl4rw8mbn4#12fd773beb3104bf_digest_top> The question of how to organize is really the core problem for a building a world where collaboration is the norm. Some thoughts and principles for one way of organizing from the bottom up: Leadership is trust earned through vision, respect, and action; not implied by position or granted from above. Leadership is not about making decisions or having authority it is about ability to effectuate the collaboration of work on for a given domain. Leadership is service. Leadership is synthesis. Leadership is mediation and mitigation. Leadership is design. Responsibility is shared and delegated at the full discretion of each individual. Anyone who has a given primary responsibility is the "leader" for that domain. That individual can delegate to others and then the others are the "leaders" for their sub-domains. The customer for the domain's services are the ones who choose the leader. For an organization as a whole, the customer is the leadership for each of the domains, e.g. the leaders of sensing and intelligence, design, manufacturing, distribution, and finance as well as representatives from the product's customers would choose the overall organizational leader. Each person chooses who they work for as their "leader" for any tasks for which they wish to obtain responsibility. Responsibility requires mutual approval by the one granting and the one accepting responsibility for a given domain. For example, if you want to work in engineering on a particular subsystem or module of a new device, then you must find someone within engineering responsible for that module who is willing to share responsibility with you by delegating a portion to you. There should be a grievance process whereby it is possible to replace leaders over a domain on initiation of either the customers for that domain, or those who are responsible for sub-domains. For domains for which we do not care to pay such close attention, or do not have time to acquire the relevant expertise, we can delegate responsibility for our decisions to someone we trust who becomes our representative for these domains. These representatives, in turn, can choose to delegate decisions to someone they trust carrying our vote with them. Decisions should be unanimous and put to vote by anyone who commits to learning enough about the issues to give the vote a fair hearing. If unanimity cannot be reached then a course which receives 95% approval should be sought, if not 95% then 90%, then 80%, and finally 2/3 supermajority as the last resort. A lack of consensus means that someone's point of view is not being heard. Vote representatives should work out any issues ahead of actual voting and learn enough to arrive at the highest possible consensus decisions by making sure everyone's real issues are addressed in any plans or decisions. All leadership responsibility is subject to a quarterly vote of customers and sub-domain leaders. Resource prioritization is handled through a point system. Each member receives 1,000 points each month and allocates gross profits between 20% to 50% each for three areas: operational improvement expenses; building and expansion expenses; and member bonus or benefits. An entrepreneur's role in such an organization is to get the leaders of the necessary groups to agree to allocate resources to the proposed project. All records of decisions and expenditures are completely open for inspection at any time by anyone.
