Fwd: [opennetcoalition] Net Neutrality: BEREC on the Right Path, Let's Keep the Pressure on

---------- Forwarded message ---------- From: La Quadrature du Net <contact(a)laquadrature.net> Date: Fri, Sep 30, 2016 at 6:19 PM Subject: [opennetcoalition] Net Neutrality: BEREC on the Right Path, Let's Keep the Pressure on To: opennetcoalition(a)laquadrature.net Press Release *Tags :* NET NEUTRALITY, BEREC, FREEDOM OF SPEECH, NEELIE KROES, PILAR DEL CASTILLO VERA La Quadrature du Net — For immediate release Permanent link: https://www.laquadrature.net/en/Net-Neutrality-BEREC-on- the-Right-Path-Keep-the-Pressure-on Net Neutrality: BEREC on the Right Path, Let's Keep the Pressure on Paris, 30 September 2016 — *Net Neutrality is one of central challenge in the application of fundamental rights in the digital space. Too often it has been only considered as a technical or commercial issue, but it has serious impact on the real exercise of right to freedom of speech, right to information and on how the society build and think of itself; but also has important impacts on industrial and commercial issues. La Quadrature du Net has followed this issue since its start in the European debate circa 2009 by trying to defend a definition and wording in EU law of a strict Net Neutrality, protecting users and guaranteeing opportunities of development in a sane digital environment. As the BEREC <https://en.wikipedia.org/wiki/Body_of_European_Regulators_of_Electronic_Com…> guidelines for the Telecom Regulation adopted in October 2015 have been published, it is time to come back on the few years of campaign and to present the next fights and challenges for fundamental rights.* La Quadrature du Net has defended, since 2009 and the first announces of EU works on Net Neutrality, an approach based on the defence of fundamental rights: to secure Net Neutrality, it is to defend the access of all to the Internet network, it is to allow to receive and send information with the same condition for all, it is to guarantee technical condition to a free and fair exercise of freedom of speech and information. It was not self-evident: as soon as the subject was within the speeches of Telecom operators and big digital companies, everything was made to consider Net Neutrality only from the perspective of financing Internet traffic and not as a major issue for the balance of the network that determines the quality of access and circulation of the information and services for the users as a whole. To tell the whole story of the fight for Net Neutrality would be as tedious as revealing of the EU and national decision-making processes, the weight of lobbying, the strength of industries but also the assets of activists and citizens who committed themselves, on the long run, for the defence of the funding principles of the Internet. For La Quadrature du Net, it means skill improvements on technological, legal and institutional fields for staff, interns, members of the board and volunteers who committed themselves for more than 6 years in this battle. This meant also getting experience of EU institutions, the strength of conviction of a handful of committed defenders of liberties, the bet of citizen participation in the legislative process, the development of original campaigning tools and adapted to La Quadrature's actions, the creation and defence of a clear and uncompromising discourse for all users, and the establishment of strong bonds and coalition with other European or international organisations also aware of the stakes of Net Neutrality for fundamental rights. Over the years, Net Neutrality's case fluctuated between hope and disappointment. In 2009, after amendment tabled by the US operator, AT&T, aiming to legalise discriminatory traffic management practices, La Quadrature du Net was the first EU NGO <https://www.laquadrature.net/en/who-wants-net-discrimination-in-europe> to oppose it. Regardless of a real lack of effort to information <https://www.laquadrature.net/files/LaQuadratureduNet-DOSSIER_Protecting_Net…> of elected representatives and citizens on this complex subject, we couldn't compel the Parliament and the Member States to write in the Telecom Package under negotiations, a disposition protecting this principle. Nonetheless, the European Commission committed to study the subject and intervene if needed after the legislative process (see annex 2 <https://archive.is/ABlVn> of the press release of November 2009 greeting the adoption of the Telecom Package). It was followed by 4 years of indecision. While in France, the Arcep and some MPs were teaching themselves on the subject through workshops, auditions and reports, the European Commission —Neelie Kroes in particular— in charge of the Digital Agenda let it wash over her. In 2011, facing the refusal of the EU authorities to consider the importance of the issue, La Quadrature du Net was at the origin of RespectMyNet <https://www.laquadrature.net/fr/respectmynet-une-plate-forme-citoyenne-rece…>, a platform allowing EU Internet users to document Net Neutrality infringements. No matter parliamentary reports calling for a legislation on this matter, Neelie Kroes opposed it. Worst, between 2011 and 2013, she kept being closer and closer to the positions defended by large EU Telecom operators, those who started a new cycle of concentration in the sector. In this context, Neelie Kroes surprised civil society by announcing during the summer 2013, her project for a telecommunications regulation <https://www.laquadrature.net/en/why-the-eu-commissions-true-intent-is-to-ki…>, which was presented as a tool to defend Net Neutrality and was very clearly inspired by the proposals <https://www.laquadrature.net/en/neelie-kroes-pushing-telcos-agenda-to-end-n…> of the big Telcos. For three years, a group of large telecom industries and universities were "explaining" —through the financing of the European Union— that the only way possible was to prioritise Internet traffic in order to finance the modernisation of the network, obviously ignoring the arguments of the people advocating for Net Neutrality. The balance of Neelie Kroes' project was: - Prioritisation of the traffic to allow Telcos to conclude agreements with large content providers, social networks, etc. (Google, Facebook...) in order to prioritise those content —discriminating all small content providers, SME, individuals, civil organisations who wouldn't have the possibility or would refuse to pay. - Creation of status for specialised services allowing a prioritised traffic whereas equivalent services —but not paying or not enough— would be de facto more difficult to access. - Implementation offers of zero rating and other pricing systems on the volume and commercial agreements, prioritising content providers. Afterwards, the European Parliament studied the text. It started disastrously by choosing Pilar del Castillo Vera <https://www.laquadrature.net/en/will-the-eu-parliament-enable-discriminatio…> (EPP - ES) as a rapporteur, who followed the path taken by the European Commission and Telcos. In November 2013, the sad picture of Net Neutrality lead few civil organisations such as La Quadrature du Net to organise themselves around SaveTheInternet.eu <https://www.laquadrature.net/en/savetheinterneteu-act-now-for-net-neutrality>. After months of difficult negotiations, the European Parliament voted in extremis, on 3rd April 2014, a text which was clearly in favour <https://www.laquadrature.net/en/net-neutrality-a-great-step-forward-for-the…> of Net Neutrality. This was a great but fragile victory for the SaveTheInternet coalition and the few MEPs who seek to defend rights and freedom from the beginning. Fragile because the Council of the European Union who had to give its position on the text and was less open to the voice of the people than to the power of large Telco companies with whom Member States have incestuous relationships. The pressure had to be maintained for over a year and half on the European Parliament to obtain in October 2015 a vote on a ambiguous text letting a large leeway for interpretation for the BEREC in charge of writing guidelines for the implementation of the Regulation in the nine next months. After a consultation who collected over 500 000 answers from individuals, NGOs and Telco professionals, the BEREC published and publicly presented on the 30 August 2016 its guidelines, stating the principles chosen to coordinate the implementation of an open Internet. The BEREC played its role by remaining closed to Telco industries and by framing especially few practices who have been underlined by the SaveTheInternet.eu coalition, such as the specialised services and traffic management measures. Moreover, if the zero rating is not forbidden, the interpretation of the guidelines should not allow to implement those kind of practices. A few important limits related to operators' commercial offers are particularly noteworthy, yet for some likely to drastically limit freedom of access to information and freedom of speech. These offers remain in a grey zone <https://www.laquadrature.net/en/50-shades-of-grey-for-net-neutrality> and will have to be evaluated on a case-by-case basis by the National Regulatory Authorities (NRAs, the ARCEP in France), until regulators coordinate with each other and develop a form of jurisprudence over their inspections. Also, in our common answer with FDN Federation to the consultation, we have raised few points unfortunately not taken into account by the BEREC: - The guidelines (paragraph 16) authorise to supply one IP address only (IPV4 or IPV6). But as IPV4 addresses are now scarce and lots of ISPs are postponing the implementation of IPV6 without providing an IPV4 equivalent, like in most of mobile Internet offers. Without a quick deployment of IPV6, the users without a public IP (even fix) will be more and more restrained in the possibility to offer content and applications. Thus the infringements of Net Neutrality made by mobile ISPs could spread if National Regulatory Agencies do not stop those practices. - At the paragraph 50 (formerly 471 <https://www.laquadrature.net/en/Net-Neutrality-BEREC-on-the-Right-Path-Keep…>), it is written that all traffic should be treated equally. Or a bad interconnection, for example with a competing service to the one of the operator could lead to an access discrimination to some contents, as it was the case in France with Youtube videos being discriminated by Free or Orange. That being said, the result is clearly in favour of Internet user's rights and as soon as it was published this has been denounced <http://www.euractiv.com/section/digital/news/internet-activists-hail-histor…> by the Telecom industries who considers it as a terrible constraint. In that sense, the BEREC's guidelines are a victory for the Net Neutrality defenders. The principle of the user having control over his/her communications and the role of the technical intermediary played by the operator are —more or less— entrenched in law. After more than seven years spent trying to put Net Neutrality in the European legislation, La Quadrature du Net is released and realises that the worst threats have been countered. And beside that the worst blocking or slowdown practices are declining, while they were commonly used a few years ago. *Nonetheless, we must stay alert during the concrete implementation of the Regulation and focus on European Regulators' future activities. The European Commission has just announced a codification of the European telecommunication law <https://ec.europa.eu/digital-single-market/en/news/proposed-directive-estab…> that may challenge the few legislative progress of the last years. The Telecom operators, currently developing convergence strategies with big media groups, are very influencing political stakeholders and they will keep fighting to reinforce their control over networks and digital economy. More than ever, European citizens' implication in controlling the efficiency of the adopted measures is need on a daily basis and thus make the regulators understand and feel that they have behind them careful users who care about the principle of a free, open and neutral Internet. Tools, such as RespectMyNet.eu <https://respectmynet.eu/> which allows documenting Net Neutrality infringements, will be maintained and further developed in order to enable citizens to play their own role in the protection of Net Neutrality. * [image: Respect My Net] <https://respectmynet.eu/> - 1. <https://www.laquadrature.net/en/Net-Neutrality-BEREC-on-the-Right-Path-Keep…> The numbering of the paragraph was modified between the version published for consultation and the final version About La Quadrature du Net La Quadrature du Net is an advocacy group that defends the rights and freedoms of citizens on the Internet. More specifically, it advocates for the adaptation of French and European legislations to respect the founding principles of the Internet, most notably the free circulation of knowledge. >In addition to its advocacy work, the group also aims to foster a better understanding of legislative processes among citizens. Through specific and pertinent information and tools, La Quadrature du Net hopes to encourage citizens' participation in the public debate on rights and freedoms in the digital age. Datum: Thu, 29 Sep 2016 10:16:10 -0400 (EDT) Von: english(a)newsletter.monsantotribunal.org An: english(a)nieuwsbriefamsterdam.nl Dear Monsanto Tribunal Supporter, In less than one month, 30 witnesses and legal experts, from five continents, will testify in The Hague before five international judges. These witnesses will tell the judges, and the world, how Monsanto has ruined their health, their communities, their livelihoods. This historic citizens’ tribunal will shine an international spotlight on Monsanto’s poisonous products and on the crimes this company has committed against human health and the environment. *We need to raise $75,000 over the next two weeks to cover the costs of this historic event. Can you make a donation today? Click here to donate by credit card or by paypal. <http://en.monsantotribunal.org/donate/>* Many of you have asked about the pending buyout of Monsanto by Bayer, and how this will affect the Monsanto Tribunal. Will the tribunal still happen? Will the name change? Will all the work and planning of the last year be wasted? Here’s the good news. *Bayer’s proposed buyout of Monsanto will have no negative impact on the Monsanto Tribunal.* Here’s why. First of all, the buyout will be challenged. And even if it’s approved, it won’t be final until well into 2017. More important, when the tribunal judges issue their final advisory opinions (about a month after the tribunal concludes on October 16), *those legal opinions will apply to all agribusiness corporations (including Bayer)—not just Monsanto.* Monsanto’s (and Bayer’s) crimes against human health and the environment, on a global scale, are well-documented.* And yet, with great arrogance, calculated planning, and riches acquired at the expense of human suffering and irreparable harm to the environment, Monsanto carries on with business as usual*—even as it looks to merge with yet another corporate criminal, Bayer. Citizens’ tribunals have a long history of drawing widespread attention to corporate corruption, and of ultimately leading to criminal trials. Like you, we want the Monsanto Tribunal to push courts in countries all over the world to hold Monsanto accountable for its crimes. *In order to have the greatest impact, we still have a lot of work to do* to finish organizing the Tribunal and People’s Assembly, and to promote the Tribunal to the public and especially to the international media. We need your help to make this a success. *Please help us raise $75,000 over the next two weeks to cover the costs of this historic event. Click here <http://en.monsantotribunal.org/donate/>to donate by credit card or by paypal.* Thank you. In Solidarity, Tjerk Dalhuisen, on behalf on the organizing committee. *P.S. The Monsanto Tribunal is a grassroots citizens’ initiative, funded by people like you. No donation is too small. Fwd: Journey to Earthland (GTN Discussion)
by Michel Bauwens 02 Oct '16

---------- Forwarded message ---------- From: Great Transition Network <gtnetwork(a)greattransition.org> Date: Fri, Sep 30, 2016 at 10:48 PM Subject: Journey to Earthland (GTN Discussion) To: michelsub2004(a)gmail.com >From Herman Greene <hfgreenenc(a)gmail.com> ------------------------------------------------------- [Moderator's Note: As noted earlier, the discussion will run through the end of October. We look forward to your contributions!] Paul Raskin’s Journey to Earthland: The Great Transition to Planetary Civilization (GT2) is a worthy successor to Great Transition: The Promise and Lure of the Times Ahead (GT1). It will become an instant classic and an enduring source of discussion about a viable future for Earthland. It is very difficult to write about a possible, non-Utopian, desirable future. The typical environmental speech goes through a parade of horribles and ends with an admonition that we need to do better and solve these problems. This is followed with completely inadequate illustrations of solutions. I think of how Al Gore ended his movie Inconvenient Truth with trifling examples of how to stop global warming. Raskin gives a well-thought-out, credible vision. Yet he correctly identifies the linchpin (or Achilles’ heel) to his analysis. He writes on page 57, “The takeaway from the quantitative analysis is highly robust; the ‘big if’ is not whether the numbers work out under Great Transition cultural and political assumptions—it is whether those assumptions can be made valid.” Due to those assumptions, I can’t help feeling that the positive vision he offers is closer to Thomas Friedman than Thomas Berry. I also can’t help feeling that his vision is more a variation of Policy Reform scenario than an illustration of a New Paradigm scenario. The “global citizens,” it seems, want a perfected industrial world. I’m not optimistic about what their lives of leisure would offer were they to come about. I’m afraid this vision was conceived by those who enjoy the benefits of modernity. In so writing, I don’t mean to diminish the achievement. I will no doubt use GT2 a lot in my own work just as I used GT1. I have tried to write the extension of my critique of industrial civilization into a vision of a viable future and have not been nearly as cogent or visionary as Raskin. GT 2 offers much to build on. For the reader, it requires consideration of alternative scenarios of the future and a reaction to the vision presented of a viable future. Here are my particular concerns with GT2. First, I don’t think it takes into account what I see as inevitable climate and ecological disruption. The positive spins on carbon budgets and the IPCC’s Representative Concentration Pathways rely on faith in negative global carbon emissions sometime in the period between 2050 and 2080 and rapid declines to carbon neutrality beginning by 2030. The most optimistic IPCC projection, RCP6, provides for stabilization of CO2 atmospheric concentrations at between 430-480ppm. I see no indication that carbon emissions are following the RCP 2.6 track and am aware that even if this were occurring there is considerable doubt that a 2.0c rise in temperature would not have highly disruptive effects or that 450ppm would result in less than a 2.0c rise. The realization of the Great Transition by 2084 does not take into account the degradation of ecosystems. Second, I think that the scenarios are treated too much as alternative pathways rather than simultaneous realities, and I think the timeline for the realization of the Great Transition is far too short. I believe a minimum of a 200-year timeline is needed and perhaps 300-500 years. I believe David Orr’s assertion in Down to the Wire that “[t]he change in our perspective from the nearer to the longer term is, I think, the most difficult challenge we will face,” has to be accepted. Bruno Latour in his 2013 Gifford lectures chided environmentalists for their frustration by writing that the reason they face resistance is not because they are not reasonable, or objective, or because their data sets are not good, it is because they are “changing everybody’s world.” He likens the situation to that of war, a 200-year world war. He wrote that we have entered a new state of nature, a Hobbesian condition of a war of all against all, with the protagonists now including tuna, and sea levels, and carbon emissions, as well as the various human factions. This time though it is not a condition before people enter into a social contract, it is a present condition. It will take 200 years to forge a new social contract. Third, I believe the concept of the “global citizen” as the principle actor in the transition lacks definition or sufficient agency. “Citizen” emphasizes the political task, or perhaps with more merit those who work for the new social contract. Insufficient attention is given to the reformer of culture and the ecologist. While it is conceivable that the production of goods will require fewer people and hours of human labor, there is no end to the work of education, spiritual growth, social engagement, ecological restoration and care, and perhaps even of food production and household maintenance, with fewer labor-saving (i.e. energy intensive) devices. To his great credit, I believe Raskin makes an appeal to progressives to avoid certain traps of the mind. Progressives have a weak vision of global society and governance. There is too much appeal to an agrarian past of happy little villages (and perhaps not enough to an agrarian future) and if not to that to technocratic, knowledge-based future. Further to his credit, with Latour, Raskin calls us to Earthland—Latour writes that the new word for the human in the Anthropocene is “Earthbound.” We ARE Earth-bound. Further, Raskin embraces technology as part of a future vision. This, it seems to me, is inevitable. Further, he relegates various alternatives as only being possible if there is collapse . . . in such case the prospect of little villages of scattered humans loses its appeal. And he calls for solutions that address an urban, scientific population of 8 billion people who continue to engage in global trade, communications and travel. I don’t know if that is the right number, but he posits a position to work from. My own work, shared with others, is around the concept of “ecological civilization, and Berry’s Ecozoic era. I see the need for a body of people to take on the “imponderables.” I’ll give just one: We say we want a sustainable future and to eradicate poverty (now often said as extreme poverty which means somewhere between $1.25 and $185 per day), sometimes without economic growth and sometimes with sustainable economic growth, all while lowering emissions. I am caught by an illustration given by Friedman, which he says he borrowed. If one gives 1 billion of the world’s poor a 60-watt light bulb (nothing else) that alone requires 60 billion watts of energy generation to power the light bulbs, and at present this means likely 120 power plants each 500 megawatts in size, fueled by coal and, if not by that, natural gas (about which we are learning more of the negative consequences of relying on fracking to run an economy on gas). The modern world IS energy. Turn off your electricity for 24 hours and you have entered a past time. How in the real world do we accomplish these conflicting goals? To me, this is an imponderable not resolved by what to me is magical thinking about “alternative energy.” In addition, we need an International Ethics Panel for Ecological Civilization (IEPEC). This idea was introduced by Ryoichi Yamamoto of Japan. The details are far from worked out, but the concept is a body of people who applies a body of ecological and social wisdom to the extraordinary challenges and conundrums of the Great Transition. The people on this listserv are leading candidates for work on the imponderables and IEPEC. We will all be building on GT2. Herman Greene Greene Law, PLLC Center for Ecozoic Societies Board of Directors, Toward Ecological Civilization ******************************* On Thu, Sep 1, 2016 at 2:09 PM, Great Transition Network wrote: >From Paul Raskin ----- Dear Friends: Our series of thematic discussions has been uncommonly rich and animated. Still, from time to time we’d best step back to a whole-system panorama, lest we lose sight of the forest for the trees. After all, it is the big question of how to shape the global social-ecological future that brings us together. In that holistic spirit, our next discussion will consider my new essay—“Journey to Earthland: Making the Great Transition to Planetary Civilization” (or “JTE,” for short). I wrote it as a sequel to “Great Transition,” the 2002 treatise that launched GTI. The new volume has four central aims. First, it updates and develops GTI’s overarching conceptual framework. Second, it introduces the idea of “Earthland” for the latent supranational community now stirring in the Planetary Phase. Third, it describes the integrated planetary praxis and global movement needed to carry the transformation forward. Fourth, it paints a granular picture of the kind of flourishing civilization that might await us on the far side of a Great Transition. To get your copy of JTE, go to www.greattransition.org/ publication/journey-to-earthland. From there, you can either download a free pdf or order a paperback through Amazon for $12. (If neither of these options works for you, please request a complimentary copy by emailing info(a)tellus.org with your mailing address.) In light of JTE’s sweeping scope, I suspect many of you will wish to elaborate certain formulations and take issue with others. I welcome your comments in the spirit of a collective exploration with ample room for difference within a canopy of unity. NOTE: This discussion will go on for TWO full months—SEPTEMBER and OCTOBER.
