Yesterday we launched a global Twitter campaign for divulgating the Open Letter and FLOK Society in general in *#OpenEcuador *hashtag Here you have the collaborative document that communication team prepared. There are a lot of tweets in English, ready to send. But feel free to tweet by your self. http://floksociety.org/pad/p/Campa%C3%B1a_Twitter_Carta_Abierta In a moment when Julian Assange is in Ecuador´s embassy in London and when capitalism seems to be exhauted, *FLOK's Open Letter ot the Commons *( http://floksociety.org/carta-abierta) and FLOK Society project ( http://floksociety.org/) can be quite important. Flok Society includes the new open world, P2P practices, open source movement, traditional collaborative indigenous practices, sharing economy and free licences that can take the world to a new paradigm. Fwd: [opennetcoalition] Crucial Moment Ahead for Net Neutrality at the EU Parliament

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Thu, Dec 12, 2013 at 6:28 PM Subject: [opennetcoalition] Crucial Moment Ahead for Net Neutrality at the EU Parliament To: opennetcoalition(a)laquadrature.net Themes: NET NEUTRALITY, EUROPEAN PARLIAMENT, CATHERINE TRAUTMANN, PILAR DEL CASTILLO VERA, NEELIE KROES La Quadrature du Net Permanent link: https://www.laquadrature.net/en/crucial-moment-ahead-for-net-neutrality-at-… Crucial Moment Ahead for Net Neutrality at the EU Parliament On September 11th, the European Commission adopted [1] an important legislative package geared to achieve the European Single Market of telecommunication and build thereby a connected continent. Since this summer La Quadrature du Net and others have tried to raise attention [2] to the threats contained in the proposal of the European Commission, especially concerning the protection of the Net neutrality principle, which the legislative proposal claims to defend in a deceiving manner [3]. This dossier is now on the table of the European Parliament [4], which is forced to work and make decisions under the pressure of a very tight calendar [5], conditioned by the upcoming elections and the political need – for each MEP involved in the process – to conclude their mandate with, at least, an intermediary legislative act. Unluckily, this scenario is not favourable to an in-depth, analytical and widespread debate on the different and relevant aspects of the proposal, which is quite technical in nature. Such a haste carries a high risk of disregard for the position of civil society organizations [6], whose contribution would be absolutely crucial to reach a decision based not purely on economic interests, but also on the defense of the freedom and rights of European citizens. Pilar del Castillo Vera (EPP - Spain), Chair of the European Internet Foundation[7] is the rapporteur appointed within the European Parliament on that file. Her draft report [8] was considered during an extraordinary meeting of the “Industry” (ITRE) Committee, held in Strasbourg on December 9th. Unluckily, the choice of the French seat, instead of the Belgian one, to hold this important step of the procedure [9], resulted de facto in a not-fully-transparent debate: no video has been distributed on the European Parliament website, which is apparently due to the absence of dedicated equipments in Strasbourg seat [10]. In addition to the non-trivial dysfunctions observed in the process, we've already pointed out [11] how the del Castillo's draft report disregards all the concerns voiced by civil society since last summer. The rapporteur's refusal to amend sensitive provisions – such as the definition of “specialised services” – would result de facto in inflicting a mortal blow to the Net neutrality principle. Until next Tuesday, on December 17th, MEPs have the opportunity to table amendments on the proposal of the European Commission and guarantee that EU citizens will be able to exert their freedom of expression and information on the Net. As a citizen platform, La Quadrature du Net provides the PiPhone [12], a web tool allowing to call Members of the ITRE Committee free of charge, to urge them to include in the final report an uncompromising vision of Net neutrality. We feel confident that, with the active support of the shadow rapporteurs, the proposal of the European Commission could be fixed in its critical points. In particular, we welcome Mrs Trautmann's (S&D - France) recent declarations at the annual conference of the European Competitive Telecommunication Association, which took place in Brussels on December 3rd. She said she wants to improve the definition of specialised services and obligate the Internet access providers to develop their activities within their networks. There is good opportunity for this to become the position of the European Parliament. If not, the Net neutrality principle will be undermined and the morphology of our communications and the nature of the information we will be able to access and impart would radically change. Protecting and defending the Net neutrality principle means thereby allowing the Internet to actively contribute to the functioning of modern democracies and protect citizens against any sorts of discrimination and abuse. If the foundations of that principle are – even barely – compromised, private stakeholders will hamper the normal and natural functioning of the Internet commons – whose rules would be decided by commercial and business logics. The proposal for a Regulation on the Telecom Package pretends to defend the Net neutrality principle by stating in its article 23.5 that “providers of Internet access services shall not restrict the freedoms [of communication] by blocking, slowing down, degrading or discriminating against specific content, applications or services”, but breaches this principle right before introducing it, allowing in its article 23.2 the provision of “specialised service […] with an enhanced quality of service" – that is to say services offering prioritization. 4. https://www.laquadrature.net/en/net-neutrality-eu-parliament-must-amend-kro… 5. https://www.laquadrature.net/en/will-the-eu-parliament-enable-discriminatio… 6. What is the psyCommons? Around 45% of the UK population have no need of 'mental health' services. They work and play, bring up children, and care for the elderly, more or less successfully. What is it they know and do that makes them psysavvy? Ordinary Wisdom and Shared Power -introduces and defines the psyCommons, an addition to the commons of air, seas, rivers and forests - a commons of vernacular psy knowledge and expertise hidden from us by the mental illness industries and the medicalization of ordinary human distress. The psyCommons is a conversation, an ongoing inquiry, to check out developments and contribute to it see psycommons.wordpress.com <http://psycommons.wordpress.com/> NB there will be shortly be a subtitled versions of Ordinary Wisdom and Shared Power in French and German. Fwd: [opennetcoalition] Huge Threats to Fundamental Freedoms and Rights Consolidated in the French Parliament

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Wed, Dec 11, 2013 at 8:45 AM Subject: [opennetcoalition] Huge Threats to Fundamental Freedoms and Rights Consolidated in the French Parliament To: opennetcoalition(a)laquadrature.net Themes: SURVEILLANCE, PRIVACY, FRENCH DEFENSE BILL La Quadrature du Net – For immediate release Permanent link: https://www.laquadrature.net/en/huge-threats-to-fundamental-freedoms-and-ri… Huge Threats to Fundamental Freedoms and Rights Consolidated in the French Parliament *** Paris, 10 December 2013 — Despite the strong citizen mobilisation and the numerous reactions [1] voiced against it, the French Senate just voted in second reading the controversial 2014-2019 Defense Bill [2] and its dangerous terms without any changes. This vote closes parliamentary debate on this text: the French Constitutional Council alone can now alter the application of these measures infringing the basic rights of citizens. La Quadrature du Net strongly calls the members of the French Parliament to formally place the matter before the Constitutional Council for a decision on the conformity of this law to the French Constitution. *** By voting the 2014-2019 Defense Bill without any changes, the French Senators just closed parliamentary debates on the subject. Despite numerous warnings expressed by citizen organisations [3] as well as public agencies [4], the text adopted today will: - Authorise live capturing of data and documents (“that on request may be captured and transmitted in real time by operators and agents mentioned” [our translation]) by hosting services and service providers. - Allow the harvesting and capturing of “data and documents treated or stored by their networks or services” (our translation) and not solely the connection data. - Extend the list of public offices that may request surveillance, to include, for instance, the Ministry of Economy and Finance. - Extend the reasons for which surveillance may be requested to include information related to “the scientific and economic potential of France” and the prevention of “organised crime and delinquency” (our translations). At this stage of the procedure, only the French Constitutional Council can stop the application of these measures opening the way to generalised surveillance of online information and communications. But this higher authority needs to be referred to by either 60 MPs, the Prime Minister or the President. La Quadrature du Net strongly calls on representatives of both chambers to hear appeals from citizens and to table a request for a constitutional review as soon as possible. “In the context of Snowden's revelations on massive and generalised citizen surveillance, it is shocking to see the French Parliament adopt a text that enshrines the state of emergency and allows total abuse of citizen's privacy. Representatives must hear the call of civil society and activate recourse to the Constitutional Council” concludes Phillipe Aigrain, cofounder of La Quadrature du Net. * References * 1. https://www.laquadrature.net/fr/pcinpact-surveillance-du-net-deluge-de-cont… 2. http://www.assemblee-nationale.fr/14/ta/ta0251.asp [fr] 3. Dear Marina, thanks for your question, I respond in my own name as I can't respond for the floksociety the flok project is funded through a tripartite agreement of the Ministry of Human Talent, Senescyt (innovation secretariat) and the IAEN public university our brief is to develop transition proposals and policy frameworks for a social knowledge economy of course this means that we are operating in contradictory environments; it is not different from working with EU funds in the knowledge of the horrible situation that the EU imposes on Greece, or working for the Spanish govt and its EUR 600k fine for civil disobedience, or the radical anti-social oif the UK govt the flok society can't be expected to take any positions on current controversies but as individuals we retain our freedom of speech I'm not particularly expert on the journalistic situation here in ecuador; to the degree that the citizens mvt had to act against the oligarchic ownership of the press it would be justified ; to the degree it silences democratic critics it would be problematic our job is to make proposals that create conditions for the flowering of open commons in every domain, which includes democratic institutions etc .. on a personal note, having lived here for one month only, it is clear that there is a lot of democratic debate and critique, both from outside the govt and from the citizens mvt that are allied with the govt and there is massive popular support for a got that has been the most successful in the world in reducing poverty and hence promoted the human capability to participate in a democracy, even by people who are otherwise critical of decisions like Yasuni etc .. also it seems the indigenous segment of the population may be the most critical (although I have no poll numbers, just several conversations) <<Message: 1 Date: Tue, 10 Dec 2013 13:06:35 -0800 From: Marina Kukso <marina.kukso(a)gmail.com> Subject: Re: [P2P-F] tweet campaign for open ecuador To: P2P Foundation mailing list <p2p-foundation(a)lists.ourproject.org> Message-ID: <CAPgqYn+j9w2wRD8aL0utv6vutSjzyXTRzkY+43JsKZnOuDJvNg(a)mail.gmail.com> Content-Type: text/plain; charset="utf-8" Dear Michael (and others), I'd love to know more about the relationship between this project, FLOK Society, and the government of Ecuador, specifically in light of some of the government's actions against journalists ( http://www.hrw.org/americas/ecuador) How does this square with the work of the FLOK Society? Gilles Babinet, appointed in 2012 as French Digital Champion to Nellie Kroes, Vice-President of the European Commission responsible for the Digital Agenda for Europe, was quoted [1][fr] in the French newspaper Les Echos, “This law is the most serious attack on democracy since the special tribunals during the Algerian War” (our translation). *** This statement comes after the public declaration [2][fr] by the Association of Community-based Internet Services (ASIC), the press release [3] by La Quadrature du Net and the opinion of the Conseil National du Numérique [4][fr] (The French Digital Council) which calls on the suppression of article 13. News articles in the press refer to the extensive attack on freedom and fundamental rights that the adoption of this article would represent. Such criticism is still building up. But time is running out because the government is using cynically the urgency of adopting the Defense Bill in order to push the article 13 through Parliament. If, on this Tuesday, 10 December, the French Senate adopts the text unchanged compared to the one adopted on first reading on 4 December by the National Assembly, then only the government would be allowed to present an amendment to withdraw article 13 in the National Assembly. If government does not backtrack, then to rescue our fundamental rights, the National Assembly would be left with the only option to reject the bill in its entirety and face the consequences that such a full rejection would entail. It is evident that faced with a bill that threatens our fundamental rights, every parliamentarian must take their decision on the basis of their own personal choice and ethics. There is no hiding behind party affiliation that could limit their ability to vote according to their personal conscience on this matter. ** Summary of the measures included in article 13 ** - Article 13 renders permanent a provisional measure introduced in the anti-terrorism legislation of 2006, extended in 2008 and 2012, and valid until 31 December 2015 (there was no urgent security need to legislate it). Not only will it be made permanent, its nature and scope are also significantly extended. - Before, the authorities were allowed to collect connection data. Now authorities may request the live capturing of data and digital documents from both Internet Service Providers and hosting services. - The type of information that may be captured and requested would include all data and documents treated or saved by these entities' networks or services. - The agencies that are allowed to request this type of information would be extended beyond those directly concerned with National Defense and Security to include, for instance, the Department of Economy and Finance. - The goals of the surveillance will be extended to include any information related to scientific and economic potential of France, or the fight against criminality. - Finally, not only will the judiciary be simply bypassed, but the only measure of control, let to the National Commission of Control of Electronic Surveillance, will only be to emit a (secret) "recommendation" to the Prime Minister, a process that carries with it no weight whatsoever.
