by ChaTo (Carlos Alberto Alejandro CASTILLO Ocaranza) 04 Jul '11

Hello P2P people, I wanted to share with you this project by Daniel Mariscal, a young video producer from Cordoba, Spain. The name is Creativos Conecta2, and it is an online TV show on Free Culture; the first program is already available at http://creativosconecta2.tv/* * The program has 2 weekly segments: "/Pensamiento Libre/" (free thinking), with news about Free Culture, and "/Creador Libre/" (free creator), that is a showcase of artists that use free licenses for their work. These are presented by journalist Ana Espejo. There is also a bi-weekly segment "/Documentos Libres/" with a micro-documentary on a related topic [disclosure: the latter is based on my free culture podcast]. Well, what I wanted to ask you guys is to *encourage him in any way you can*. For instance if you know of Spanish artists that want to showcase their works in his /Creador Libre/ segment, please go ahead and suggest them to do so. Also if you speak Spanish, and like the show, just drop him a brief e-mail or tweet. Thank you, -- *ChaTo (Carlos Castillo) <http://www.chato.cl/>* /Let's connect! · LinkedIn <http://www.linkedin.com/in/chato> · Facebook <http://www.facebook.com/chato/> · Twitter <http://twitter.com/chatox>/

Fwd: [opennetcoalition] EU Commission Kicks Off Campaign to Defeat ACTA
by Michel Bauwens 01 Jul '11

01 Jul '11

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Thu, Jun 30, 2011 at 9:38 PM Subject: [opennetcoalition] EU Commission Kicks Off Campaign to Defeat ACTA To: opennetcoalition(a)laquadrature.net La Quadrature du Net - For immediate release Permanent link: http://www.laquadrature.net/en/eu-commission-kicks-off-campaign-to-defeat-a… EU Commission Kicks Off Campaign to Defeat ACTA *** Paris, June 30th, 2011 – The European Commission adopted proposals for the ratification of ACTA, the anti-counterfeiting agreement. This opens the door to concerted citizen action in defeating ACTA, as it will be voted upon by both the European Parliament and national Parliaments. Among the many texts and policies that try to pave the way for the private censorship of the Internet, ACTA symbolizes the worse circumvention of democracy by a few narrow interests. Democracy must fight back. *** After having adopted the two proposals for the signing [1] and adoption [2] of ACTA, the Commission transmitted both proposals to the EU Council of Ministers, who will soon adopt them as well. Member States will ask their national Parliaments across the 27 Member States to vote on the text, which will then be put to the vote before the EU Parliament [3]. This secretly-negotiated agreement – far from being limited to trade policy – would impose new criminal sanctions to signatories that are both ill-defined and extremely large in scope. These sanctions would apply even to not-for-profit infringements of copyright, patents or trademarks [4]. In the digital environment, its entry into force could result in the development of extra-judicial modes of copyright enforcement. Under the guise of “cooperation”, ACTA would actually violate the right to a fair trial and harm Net neutrality and freedom of expression [5]. This strategy was once again reaffirmed by the European Commission copyright strategy [6] and the G8 summit [7] last month, and just yesterday by the OECD principles on Internet policy-making [8]. The ratification process opens the door to the mobilisation of EU citizens, corporations and NGOs, to work together in defeating this totally undemocratic agreement, bound to harm freedoms and innovation across the world. “The time is now! This is a historic battle in the "war on sharing" that we cannot afford to lose. Every citizen who cares for a free Internet, the protection of fundamental freedoms and democracy must participate in defeating ACTA. European and national members of Parliament must follow the example of their Mexican counterparts, and reject ACTA. All democratic means should be used to defeat this massive circumvention of democracy attacking our freedoms to protect a few obsolete industries.”, says Jérémie Zimmermann, spokesperson for La Quadrature du Net. * Références * 1. http://register.consilium.europa.eu/servlet/driver?typ=Advanced&cmsid=639&f… 2. http://register.consilium.europa.eu/servlet/driver?lang=EN&ssf=DATE_DOCUMEN… 3. Understanding European Governance ? - in context of Tobin Tax
by Dante-Gabryell Monson 30 Jun '11

30 Jun '11

Below, a report showing the interest from the European Parliament in relation to Financial Transaction Taxation. // * * *further notes, on how difficult in might be to actually adopt such financial transaction tax through elected representative political procedures :* The Parliament seems, in my current understanding, to have only a limited influence : *a diluted power to approve or reject directives made by the European Commission.* [image: image.png] ( link to image - wikipedia )<http://en.wikipedia.org/wiki/File:European_Union_legislative_triangle.svg> Based on the report below, it feels like the EU Parliament does not have the power to choose the laws it wants to vote on, and which have precedent on all other national and regional legislations. It seems to me that the combined powers of the EU Parliament and of all the other National and Regional Parliaments is less then that of the European Commission and the European Council. It seems - based on my current knowledge - that the EU Parliament, in relation to proposals for directives, is merely relegated to a pressure group with some kind of attention from media, towards a population which has no powers to elect nor the European Commission, not the President of the European Council , or more exactly the Councilium of the European Union<http://en.wikipedia.org/wiki/Council_of_the_European_Union> The EU Parliament seems to have even less powers then the Council of the European Union , as the Council seems to have the power to initiate EU law itself : http://en.wikipedia.org/wiki/Council_of_the_European_Union *" In a few limited areas the Council may initiate new EU law<http://en.wikipedia.org/wiki/Law_of_the_European_Union> itself. "* Hence, overall, the framework for political "democratic" accountability<http://en.wikipedia.org/wiki/Accountability>seems to be very limited, despite the EU Commissioners needing to be approved once every few years by the European Parliament, a European Parliament which itself is, at the scale of the population of the EU who voted, apparently not very legitimate, considering the low voting turnout. http://en.wikipedia.org/wiki/European_Parliament_election,_2009 http://en.wikipedia.org/wiki/Elections_in_the_European_Union#Voter_behaviour *"In 2009, the overall turnout was just 43%"* ---------- Forwarded message ---------- From: * * yes, I think you'e right about the directives taking precedence, I so need to find out more about how it all works tho! Here is one of our press releases anyway: Financial transaction tax European Parliament keeps pressure on for European FTT The European Parliament today reiterated the call for the introduction of an EU-level financial transaction tax, as part of a report on innovative financing adopted by MEPs. The Greens have long called for the introduction of a financial transaction tax and welcomed the vote, with Green MEP *Philippe Lamberts* commenting: *"The EP has kept the pressure on for the introduction of a financial transaction tax at EU-level. While the ultimate goal should be to introduce a global FTT, there are clear benefits for the EU to push ahead on its own. MEPs have today urged the Commission to take steps to this end.* ** *"The Greens have long championed the introduction of a financial transaction tax both as a means of curbing harmful speculation and as a new source for generating public revenue. As well as being a potentially significant source of revenue at a time when national exchequers are under strain, a financial transaction tax is socially just. A FTT would also clearly address the systemic risk emanating from high-frequency trading, acting as a disincentive for risky speculation. It is time for the Commission and member states to stop stalling."* The petition thing is the "European Citizens' Initiative" which coincidentally enough was just launched today and there is even a conference starting now on it! The Greens have also created a website (http://www.eci-greens-efa.net/) that will function as a sort of hothouse/message board to allow people all over Europe to get together to launch one of these initiatives. Livestream of conference now: http://www.greenmediabox.eu/live/eci/ Date: Wed, 29 Jun 2011 15:44:10 +0200 Subject: Re: article trends : 2 Belges sur 3 veulent taxer les transactions financières From: dante.monson(a)gmail.com To: p2p-foundation(a)lists.ourproject.org; econowmix(a)googlegroups.com; gtmonnaie(a)gtmonnaie.be Unfortunately, the situation of the current Belgian "caretaker" Government may not make it possible to bring forward and apply such Tobin Tax measures. And even if it did ( although I would need some more expert opinion on this ) my current understanding is that the European Commission drafts directives can block or over-rule national or regional decisions. To my current understanding, directives of the European Commission http://en.wikipedia.org/wiki/European_Union_law only need to be approved by the European Council and the European Parliament - not by national governments. To my current understanding, it is not the european parliament which drafts law proposals at a european level. For the European Commission to "consider" to draft or change a directive, there is the "option" to make a petition converging one million signatures. ( under specific conditions - percentages from each country, etc ) And even after such petition asking for writing or modifying a directive, there is no obligation for the commission to follow suit on such request by one million people. * * *Badi BALTAZAR* -- P2P Foundation: http://p2pfoundation.net - http://blog.p2pfoundation.net Connect: http://p2pfoundation.ning.com; Discuss: http://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation Updates: http://del.icio.us/mbauwens; http://friendfeed.com/mbauwens; http://twitter.com/mbauwens; http://www.facebook.com/mbauwens

Fwd: Netherlands : €200 million slashed from the arts and culture budget
by Michel Bauwens 30 Jun '11

---------- Forwarded message ---------- From: Dante-Gabryell Monson <dante.monson(a)gmail.com> Date: Tue, Jun 28, 2011 at 9:23 PM Subject: Netherlands : €200 million slashed from the arts and culture budget To: econowmix(a)googlegroups.com http://www.wired.com/beyond_the_beyond/2011/06/the-dark-age-netherlands excerpt : “A new Dark Age for Dutch Culture “The letter ‘Meer dan kwaliteit’ (‘More than Quality’) by the State Secretary for Culture, Halbe Zijlstra (VVD, People’s Party for Freedom and Democracy) arrived in the electronic mailboxes of Dutch art and cultural institutes on Friday, 10 June 2011. It stated that €200 million would be brutally slashed from the arts and culture budget, starting as early as 1 January 2013. “Apparently, Zijlstra, who admits that he lacks any understanding of art and culture, has blatantly ignored all the recommendations made to him on this subject, including those from the Arts Council (the government’s official advisory body). Subsidies for a limited number of ‘world-class institutes’ such as the Nederlandse Opera, which already receive a substantial portion of the existing budget, will be maintained. As far as Zijlstra is concerned, most of the other institutes can disappear – they will no longer be able to rely on structural support from the government. “This not only applies to all the production houses for theatres, half of the orchestras, the Muziekcentrum Nederland (formed in a recent merger), the Foundation Art and Public Domain (SKOR), renowned exhibition spaces and research facilities for visual art such as De Appel, but also to the entirely new media sector with its internationally acclaimed institutes such as V2_, the Netherlands Media Art Institute (NIMk), Mediamatic, WORM, the Waag Society and STEIM, as well as to the Rijksakademie, de Ateliers and the Jan van Eyck Academy. Support for critical-analytical journals such as Open and Metropolis M, and for the literary magazines, including De Gids, will be discontinued. Furthermore, the budget that will be allocated to project subsidies, i.e., for individual artists, one-off projects and festivals, will be more than halved. Only ‘international world-class talent’ and art that has already proven itself will remain. -- P2P Foundation: http://p2pfoundation.net - http://blog.p2pfoundation.net Connect: http://p2pfoundation.ning.com; Discuss: http://lists.ourproject.org/cgi-bin/mailman/listinfo/p2p-foundation Updates: http://del.icio.us/mbauwens; http://friendfeed.com/mbauwens; http://twitter.com/mbauwens; http://www.facebook.com/mbauwens

Fwd: [fcf_discussion] OECD Draft Internet Communiqué Sacrifices Freedoms to Copyright
by Michel Bauwens 30 Jun '11

---------- Forwarded message ---------- From: La Quadrature du Net <jz(a)laquadrature.net> Date: Tue, Jun 28, 2011 at 11:17 PM Subject: [fcf_discussion] OECD Draft Internet Communiqué Sacrifices Freedoms to Copyright To: fcforum_discussion(a)list.fcforum.net La Quadrature du Net - For immediate release Permanent link: http://www.laquadrature.net/en/oecd-draft-internet-communique-sacrifices-fr… OECD Draft Internet Communiqué Sacrifices Freedoms to Copyright *** Paris, June 28th, 2011 – La Quadrature du Net adds its voice to the 80 global civil society groups that have declined endorsing the OECD's communiqué on Principles for Internet Policy-Making. Although the text puts forward positive recommendations, rights and freedoms online are severely undermined by the call for private policing of the network, opening the door to automated censorship in the name of copyright. *** The 80 global civil society groups represented at the Organization for Economic Co-operation and Development (OECD) under the umbrella of CSISAC have rejected the draft communiqué on Principles for Internet Policy-Making. La Quadrature du Net adds its voice to that of CSISAC, and regrets the OECD member countries' stubborn defense of the entertainment industries' obsolete business models, which is bound to undermine the very principles that the communiqué rightly puts forward. OECD LogoThe draft communiqué unfortunately shows that the OECD member countries are pushing for the same flawed online copyright policies as the ACTA agreement1, the G8 conclusions2 and the EU strategy3 for the future of copyright. The draft communiqué contains crucial elements of wording seeking to weaken the liability exemptions enjoyed by Internet companies such as search engines, hosting or access providers4, to turn them into a private copyright police and justice. The OECD draft communiqué reads: “Internet intermediaries could take steps to [...] assist rights holders in enforcing their rights or reduce illegal content,[...], respecting fair process [...]”, with “fair process” being explicitly defined with no reference to the judicial authority. It is clearly designed to allow rightsholders to bypass citizens' right to a fair trial. Thus, the OECD communiqué legitimates policies bypassing the judicial authority for online law enforcement, particularly in the name of an obsolete copyright regime. It also mentions that “users should have the ability to access and generate lawful content”, thus limiting free speech, and paving the way to private, automated censorship where machines would determine what is lawful or not, rather than a judge. “If left unchanged, the OECD communiqué is poised to promote a decade-long war on sharing, which has already had disastrous consequences on freedom of expression and privacy worldwide. Under the pressure of the entertainment industries, the OECD is undermining the good principles laid in its framework for Internet policy-making. Fundamental freedoms and the rule of law should prevail over any private interest, and that means guaranteeing a fair trial to all Internet users rather than pushing for private policing and censorship”, concluded Jérémie Zimmermann, co-founder and spokesperson of the advocacy group, La Quadrature du Net. * Références * 1. http://www.laquadrature.net/en/ACTA 2. http://www.laquadrature.net/en/frances-g8-focuses-on-control-and-restrictio… 3. http://www.laquadrature.net/en/eu-commission-sticks-to-flawed-copyright-rep… 4. Instead of strongly affirming liability exemptions and why there are important, the draft calls for their active involvement in law enforcement:.The draft reads “Internet intermediaries, like other stakeholders, can and do play an important role by addressing and deterring illegal activity, fraud and misleading and unfair practices conducted over their networks and services as well as advancing economic growth.” ** About la Quadrature du Net ** La Quadrature du Net is an advocacy group that promotes the rights and freedoms of citizens on the Internet. More specifically, it advocates for the adaptation of French and European legislations to respect the founding principles of the Internet, most notably the free circulation of knowledge. In addition to its advocacy work, the group also aims to foster a better understanding of legislative processes among citizens. Through specific and pertinent information and tools, La Quadrature du Net hopes to encourage citizens' participation in the public debate on rights and freedoms in the digital age. La Quadrature du Net is supported by French, European and international NGOs including the Electronic Frontier Foundation, the Open Society Institute and Privacy International.
