El gobierno de Colombia acaba de someter a tramitación legislativa un
proyecto de ley que reglamenta la responsabilidad por la infracción a los
derechos de autor en Internet. La iniciativa, que va más allá de lo previsto
en cualquier otro país al respecto, promete protección a toda costa,
sacrificando los derechos de los usuarios y la competitividad de los
prestadores de servicio de Internet locales.

A través de este proyecto de ley, el gobierno de Colombia cumple
parcialmente con la implementación del Tratado de Libre Comercio suscrito
con los Estados Unidos, a pesar de que éste no ha ratificado el acuerdo aún.
De hecho, el Congreso de los Estados Unidos no ha aprobado el tratado y, en
cambio, ha expresado serios resquemores por la protección de los derechos
humanos y los derechos laborales en Colombia. Si el proyecto de ley
prospera, el Congreso americano deberá agregar a sus preocupaciones el
inadecuado respeto de derechos civiles, como los derechos a un juicio justo,
a la privacidad, y la presunción de inocencia, entre otros.

The government of Colombia has just submitted to the legislative process a
bill regulating liability for infringement of copyright on the Internet. The
initiative, which goes beyond the provisions of any other country in this
respect, promises protection at any cost, sacrificing the rights of users
and the competitiveness of  the local Internet Service Providers.

Through this bill, the government of Colombia partly complies with the
implementation of the Free Trade Agreement with the United States, although
it has not yet ratified the agreement. In fact, the United States Congress
has not approved the treaty, and instead, has expressed serious misgivings
about the protection of human rights and labor rights in Colombia. If the
bill succeeds, the U.S. Congress should add to its concerns the inadequate
respect for civil rights, like the rights to a fair trial, privacy, and the
presumption of innocence, among others.
