Hi to all, we are almost one month behind the deadline and we got no progress at all in the proposal writing for the "Centre for Copyright and New Business Models in the Creative Economy" (http://p2pfoundation.net/projects/doku.php/centre:resume). At this point we would need to evaluate if we got the necessary commitment to achieve the proposal preparation objective. It would be good to know if Jussi and Volker would be able to lead this project as was expected. Thanks and best regards, -- Franco Iacomella
Dear Franco et al sorry for the radio silence - got swamped with submitting another bid and other work (summer time rush!) In any case, even if I want to do my best to support and participate, I don't think I am the one to lead this eventually. However, we (well, Lorraine and Sean) have been able to push this forward at our end after realizing that some other Southampton people have been already doing work in this direction already. So, if I am not mistaken, there was a meeting couple of days ago about this bid/centre possibility, where Sean and Lorraine took part. They might have news on where the meeting ended off and where to take this now. This also might have some interesting details concerning the bid: http://www.bis.gov.uk/news/topstories/2011/Aug/reforming-ip apologies for the silence, all best J On Sun, Aug 7, 2011 at 2:31 PM, Franco Iacomella <[email protected]>wrote:

Dear Franco, all, thanks for pinging us. Yes, you are absolutely right, we have to get moving. I was delayed due to my Lebanon trip and a crashed computer but I did start to work on the sections off-wiki. I am confident that we will be able to work out appealing proposals to most of them. However, two I think are time-critical. Since it is an 80% funding, we will have to come up with an additional £1.25 million. Google came to mind. They just committed €4,5 million to an Institute for Internet and Society at Humboldt University that will be launched in October. That might make it less likely that they support another research institute but I could ask. The question is would we feel comfortable with Google? Which other funding partners could you think of? How much could University of Southampton contribute, if any? Do contributions in kind count, i.e. infrastructure for hosting the Centre? What could be sources of sustained funding after the four-year period? Can we mention EU FP8 calls even though we know that the success rate is only 10%? The other issue that will take time is finding partners. Here are some candidates: - Berkman Center, Harvard - Center for Technology and Society, FGV Rio - NEXA Center for Internet and Society, Politecnico di Torino - IvIR, Amsterdam - MPI for Intellectual Property and Competition Law, Munich - the COMMUNIA Non-Profit Association - Rufus, Pollock, Open Knowledge Foundation - Philippe Aigrain, Paris - Alan Story, University of Kent Depending on what issues we want to highlight (e.g. open access, privacy, mobile phones, collective management) others come to mind. Given the strong emphasis on creative industries, partners from some of the sectors would certainly be an asset, e.g. the new Games Lab at Paderborn University. But very likely these should be UK institutions which I am less familiar with. How about Mute Magazine? I could approach all of those mentioned but would like to get feedback from you first. Shall we brainstorm on funding and partners over the next days? I will also send drafts on the other sections so we have something to work with. Dear Volker and Jussi, thanks for your quick answer. About Volker concerns: I think that the additional 20% funding is not an easy one. Google it's an option, but of course would depend on their conditions. Another options are smaller funding organisations, but I think should be based in the UK. Maybe Soros-OSI it's an option? About the non-funding partners: Volker's list is really good. I can suggest CopySouth, Information Society Project (Yale), iCommons and FLACSO (Latin American Faculty of Social Sciences). However, I need to clarify that on this bid status we need to present a "expression of interest", so I think we should focus on getting some letters of support from the partners that would eventually participate. That would show in someway the quality of the network of organisations that would support our centre. Volker, would be great if you publish what you have in the wiki space. If the rest of you agree, we should have a phone call or some kind of meeting as soon as possible. Best regards, Franco. El 07/08/11 18:23, Volker Grassmuck escribió:

Sorry - forgot to paste the record of the meeting last week: Ian Hargreaves wrote the major report on copyright which the UK government has announced it will be implementing "for the most part" Phil Nelson is the head of research sean Dear All, An initial meeting was held today with Lorraine Warren, Sean Cubitt, Gehard Kling and Luc Moreau, to discuss direction and ideas for an EOI for the Centre for Copyright and new Business Models in the Creative Industries. In summary: There was discussion and agreement about the value of comparisons between alternative methodologies such as peer to peer, creative commons, gift economy and crowd sourcing - and existing IP approaches; from legal, business and cultural/historical perspectives. There was agreement about the need to develop models of 'how to measure value' in the creative industries, and comparisons of business/value models – identifying what models drive success in the creative industries. As there will be one centre funded in the UK there will need to be considerable links either Hub and spoke or as networks. Current links with Brighton, Sussex, The British Film Institute and the London International Film School were mentioned. Partners would need to include SME’s/SME membership organisations such as the South Coast Design Forum. It is clear that the successful bid will have considerable collaborations across the range of creative and digital industries, as well as world leading academics across the relevant fields. As attendees had to leave at this point, it was agreed that I would circulate the summary of this initial meeting. The next steps will need to be academic decisions about: · Who will lead an IOE? · Do we want to be a ‘Lead HEI’ or would we want to partner? (It was raised as an observation that that whichever bid Ian Hargreaves (Cardiff) is involved with may well stand the best chance, as he is a key driver in this area of policy) NOTE: We can only be a Lead HEI on one bid, but the call documentation is silent about partnering on more than one bid. Please let me know if a bid will be progressed (either as a Lead HEI or partner HEI) and Research and Innovation Services will provide support as required. PLEASE NOTE: I will be on leave from 4th – 10th August and again from 20th to 30th August, but Niki Price (Bid Manager)[email protected] will be available to support the bidding process. Any bid will have to be signed off by Phil Nelson. Two messages in this morning from colleagues at Southampton's research office (neither are academics - most of whome are on holiday or trying to write their books ;(
I will have a go at drafting a short idea for what we could aim for, and putting together our circulation with the circulation list for the university discussion I'm recently returned to the UK after 11 years overseas so the number of contacts and knowledge of institutions is weak. On the other hand, a bid with a strong EU presence - even though the CFP is specifically about the UK could be a strength for us. We do NOT know that the presence of Hargreaves is vital. Dear All I would have thought this needs to be lead by a senior academic from a Business / Law discipline with track record in this area. Franco, thanks for relaunching the process and discussion, which I have just been catching up on.
Apologies for my own radio silence, which may last another 2-3 days, I have had a serious flu, and though I'm feeling better, internet is still exhausting right now. I should be okay at the end of the week,

I will have a go at drafting a short idea for what we could aim for, and putting together our circulation with the circulation list for the university discussion
I'm recently returned to the UK after 11 years overseas so the number of contacts and knowledge of institutions is weak. On the other hand, a bid with a strong EU presence - even though the CFP is specifically about the UK could be a strength for us.
We do NOT know that the presence of Hargreaves is vital. (Unfortunately I do have a connection with Cardiff but it will not be helpful - long story: my predecessor at Melbourne)

Thanks Nikki and sorry wasn¹t about to make the meeting.
Dear All
I would have thought this needs to be lead by a senior academic from a Business / Law discipline with track record in this area. Clearly there should be close links to those in arts, IT etc. Unless we can rapidly find a natural and credible lead from within Southampton I would have thought our best option is to partner. Please note I did spot in the call document that an organisation can only be in one Bid (see pt 5 on eligibility). Further we also do need to be able to articulate (albeit briefly for the EOI) how this centre would be sustainable into the future ŠŠ
I am not sure whether our own Law team and in particular Steve Saxby have/has expressed an interest &/or identified who would be the stiffest competition/best partner but I would hope they would be able to advise. From a non-academic perspective (but legal with some interest in this field) I wonder whether Queen Mary¹s University of London Œs Centre for Commercial Law Studies might be quite a big hitter as they do quite a bit in IT and Media lawŠ. ? They certainly fielded a few people to the workshop. http://www.ccls.qmul.ac.uk/Research/it/index.html
Christopher Millard provides them with a close link to Oxford¹s Internet Institute as he is part-time at both.
Subject to our wanting to lead would it be worth seeing if they were putting in for a bid at all and potentially offer to link with them? Indeed we could ask them anyway in order to gauge if they are competition.
Also Bournemouth University Centre for IP & Policy Management - http://www.cippm.org.uk/research.htmlcould well be thinking of going for it in which ditto in relation to partnering/competing with them?
Link to Hargreaves report in case you don¹t already have it (you probably do as it has been mentioned previously) http://www.ipo.gov.uk/ipreview-finalreport.pdf but also there are a number of supporting documents which are informative http://www.ipo.gov.uk/ipreview/ipreview-documents.htm
Some other suggestions in case they are of help:
1) Would you agree any bid might benefit from some of the following as partners/ representatives in steering capacity in addition to the various industry sectors identified in the call? -British Library -Selection of Law Firms leading in this field -Collecting societiesy / copyright licensing agencies
2) Another refreshing inclusion could be around the education piece (strong theme in Hargreaves) potentially building a strand about curriculum development during schooling years rather than leaving for businesses to tackle it and later stage learning?
3) The expectation should certainly be to have UK IPO on any steering panel which I believe is implicit from the call. The University also has links to the CBI Intellectual Property Committee which includes a number of the major players in some of the industry sectors involved. If we were to lead it may be possible to link through to them for a steering group representative. I can assist in providing that link if there is a decision to lead.
Overall we must be mindful of the selection criteria for the 1st stage: · fit to the call specification € demonstrable expertise in delivering excellent and relevant research € strength of vision and leadership € the added value of the Centre¹s overall aims, approach and activities (i.e. the Centre should be more than the sum of its parts) € the strength of any proposed partnerships between partner institutions and the infrastructural support offered by all partners, especially the host institution € the quality and potential of existing and proposed partnerships with stakeholders and other, non-academic organisations and the nature of the relationship € the extent to which proposed activities respond to current priorities and potential future challenges € potential to deliver impact € plans for a sustainable legacy € value for money (including the potential to obtain additional income).
I am not sure if there is a follow up meeting but if one is planned will engage should you want.
Kind Regards
Diana

Do we assume that any bid led by Professor Ian Hargreaves, Chair of Digital Economy at the Cardiff School of Journalism, Media and Cultural Studies/ Cardiff Business School is a very strong contender given that the Government has just accepted all ten recommendations made in his independent review on intellectual property? If so, does the group have any good connections it can exploit, or a history of collaborating with Cardiff in this area? Or is it too late to pursue that avenue?
Kind regards

Dear all, I’ve put some ideas onto the wiki, including some from Sean’s notes. Please consider it brainstorming material. It is not in EoI language yet. Principles/Vision and Research Topics: http://p2pfoundation.net/projects/doku.php/centre:key_features Partners that were mentioned so far: http://p2pfoundation.net/projects/doku.php/centre:partnership Funding (still very few ideas) http://p2pfoundation.net/projects/doku.php/centre:funding_and_legacy Also I’ve received a very general expression of interest in partnering with us from IvIR. Naturally, they will need further information from us for pursuing their discussion, but it’s a good start. Best, Volker
Thanks Volker - looks excellent. There may be work to do to include the Southampton researchers from other areas - eg Gerhardt's work is on the development of new business modelling procedures for service industries (I didn't follow in detail: he seemed to suggest that standrad business modelling is based on the manufacturing sector, assessing the profit to plant ratio, and in other ways not suitable for creative / service sector industries Luc's expertise is in data provenance sean On 10/08/2011 16:15, "Volker Grassmuck" <[email protected]> wrote:

Yes, indeed, if we know who will be involved in case we win the call, it would be best to start from collecting research areas and topics from each person. Michel, Franco, please also add what you and others you see involved will be doing. Also, if Southampton is going to be the lead applicant, we need an outline structure of the Centre and indications of how it will be administratively and academically embedded in the university. Also I would assume, even though it doesn’t say so in the instructions, that the structure with personnel etc. has to roughly match the budget of £6.25 million over 4 years. Stub here: http://p2pfoundation.net/projects/doku.php/centre:centre_structure As for the positions of Director, it was very kind and flattering of Michel to suggest me, but I’m not sure my credits (not a professor) and track record carry enough weight. I can send my CV and let you judge, but we should discuss the alternatives we have. Best, Volker

Hi Franco and colleagues I will be discussingthis with members of the Southampton research office shortly - basically they have asked me - as the only person not on leave - to draft an expression of interest. This will have to be quite open: we must involve other interest groups in the university; and there may be constraints on links with other UK institutions On the positive side, we are near fixing a public debate between Lawrence Lessig and Ian Hargreaves, the author of the Digital Britain report that started al this Here are Diana Galpin's notes; followed by her response to my suggestion that Volker might be the director. I need to know the legal standing of P2P (registered charoty / trust / not-for-profit / country/ies of incirporation etc for these pruposes; also Volker I am presuming you are freelance for these purposes: can you send me a CV I have a skype conference with the admin team this morning at 11.30/12 BST Sean Wednesday, 17 August 2011 14:06 Sounds a good result. Niki P checked with AHRC and their response was that an international company could participate in Œmutually beneficial¹ hub based activities that were badged under the heading of Œinternational cooperation¹ and paid for using the grant. The reciprocity would arise from the fact the company might be making a contribution to the project (indirectly) through their participation and bringing new knowledge/expertise into the arena. Thanks for sharing the details, so essentially we are a nonprofit 'foundation' under dutch law, recognized by the EU, and we also have a legal Dutch coop that is associated with it, whenever a 'private' partner is required, the Association of P2P Researchers has no legal existence, and has not yet been formally launched, though it reflects the reality of a network of interested researchers, Michel On Fri, Aug 19, 2011 at 3:26 PM, Cubitt S.R. <[email protected]> wrote:

Thanks for sharing the details,
so essentially we are a nonprofit 'foundation' under dutch law, recognized by the EU,
and we also have a legal Dutch coop that is associated with it, whenever a 'private' partner is required,
the Association of P2P Researchers has no legal existence, and has not yet been formally launched, though it reflects the reality of a network of interested researchers,

However, it would not be possible to pay an international company for other goods and services or enter into a contracting/sub-contracting relationship on a one-to-one basis using AHRC grant monies. Of course that was with respect to them being a companyŠ are they? Before we can get definitive advice from AHRC can you confirm what type of organisation they are and in what capacity you would expect them to be involved? If you are going ahead with a telecom probably worth including Nikki Matthews as she probably has most capacity to provide the RIS support to you at the moment.

On the positive side, we are near fixing a public debate between Lawrence Lessig and Ian Hargreaves, the author of the Digital Britain report that started al this

Sounds a good result. We do need to be careful about what and how much we expect P2P to do as from the looks of things they are an international organisation. Now that is fine but we may not be able to flow grant monies to them..
Kind Regards
Diana

Careful on the automatic ³employ Volker as a director² front being your easy fix as any role would need to be advertised externally following usual University of Southampton HR and recruitment policiesŠ I am also not entirely sure whether due to limitations on our insurance, health & safety risks & complexities of then having to adopt local employment laws etc that we would employ someone to be permanently based overseas
Sorry not trying to put barriers in the way but help guide you to what is possible/not!

Dear Sean, thank you for taking the initiative on drafting the EoI. I’m happy to work on the parts I can, but for many of the issues of how the Centre plugs into the Southampton structures and into UK contract and budget rules local knowledge is essential. I’m under contract at Paderborn University until the end of September. Not quite clear where the next half year will take me. But whatever it will be, I’ll make sure that I’ll be available for our Centre. CV coming up in separate mail.

I’d be happy to move to Southampton for the initial four years and possibly longer. Best, Volker
Thanks V (also for CV I have got the Humanities faculty aboard; and also a strategic alliance with Sally Jane Norman at Sussex: we had worked on another bid allying south coast institutions: Brighton where she is based in the institutional hub for arts administration south of London, and with us constutitutes a recognisable region , a good feature for us. Dear Sean, all, Am 08.08.2011 um 15:57 schrieb Cubitt S.R.:
Hi
We have had meetings with other research staff at southampton. I'll attach / paste the record of the meeting. There are suggestions that this may not be a very open call, but none of us know for sure.
The suspicion is always there, especially with highly politicized endeavours as this one. But if there are indications already should we invest the energy at all? Are there ways for confirming this?
I said I woud try to circulate something early this week in draft but was delayed returning from Amsterdam. We also have some ideas of other collaborators, especially along the south coast - there are strong reasons to go for collaboratons. This relates to another important thoughtin the notes: creative industries are characteristically small - family / individual small group practices in design etc etc. Big collaborators may or may not help understand their economics. Regional associations wd be an excellent way to reach many small companies - better tyhan contacting one big one.
Important point and great idea. I wouldn’t be able to help with UK regional associations though.
I also suggest we work with entreprises who may have diffeent ideas, especially in distribution - people like Rough Trade Records, or Lux film-video distributors: indie distribution has always lived from hand to mouth but can't afford - usually - open access
Some do. Vodo.net comes to mind. Jamie King would actually be a great person to cooperate with. But then should that be an institutional partnership that would lend weight to the EoI? A sectorial association of SMEs might. But Vodo, I think would be great for an in-depth study on voluntary payments, comparing it to Rough Trade etc., challenging the assumption that they can’t afford free access, building on the work of Yochai Benkler et al., Everything in Its Right Place: Social Cooperation and Artist Compensation http://www.mttlr.org/volseventeen/belsky_kahr_berkelhammer_benkler.pdf
It is a pain they have chosen this time of year: suggests they are keen to reduce the number of centres competing
I'll try to outline a workable idea overnight or tomorrow morning - it has to go round our Southampton colleagues in busines school, engineering and compter science etc, alliances which are not as conservarive as I feared, by any means, but have what they regard - probably with reason - as a more realistic apprach to the process of persuading a now throughly ideological grant-giving appararus reasons to give us the money
Very good. A good portion of strategic realism and knowledge of the apparatus we’re dealing with is certainly necessary to succeed. Best, Volker

Dear Franco, all,
thanks for pinging us.
Here are some candidates:
- Berkman Center, Harvard - Center for Technology and Society, FGV Rio - NEXA Center for Internet and Society, Politecnico di Torino - IvIR, Amsterdam - MPI for Intellectual Property and Competition Law, Munich - the COMMUNIA Non-Profit Association - Rufus, Pollock, Open Knowledge Foundation - Philippe Aigrain, Paris - Alan Story, University of Kent
Depending on what issues we want to highlight (e.g. open access, privacy, mobile phones, collective management) others come to mind.
Best, Volker

Hi to all, we are almost one month behind the deadline and we got no progress at all in the proposal writing for the "Centre for Copyright and New Business Models in the Creative Economy" (http://p2pfoundation.net/projects/doku.php/centre:resume).
At this point we would need to evaluate if we got the necessary commitment to achieve the proposal preparation objective. It would be good to know if Jussi and Volker would be able to lead this project as was expected.
Thanks and best regards,
